Recommendation Regarding Retention of Contractors to Provide Technical and Contract Administrative Support for the AB 2766 Discretionary Fund Program as Part of the Fiscal Year 1995-96 AB 2766 Discretionary Work Program

The AB 2766 Discretionary Fund Program receives thirty cents of every dollar of an annual $4 vehicle registration fee collected pursuant to Assembly Bill 2766. It is estimated that approximately $11.7 million in revenue will be available in Fiscal Year 1995-96. In accordance with Health & Safety Code Section 44233, of this $11.7 million, no more than 5% or $585,000 may be used to support program administration. On June 22, 1995, the Mobile Source Air Pollution Reduction Review Committee approved the reimbursement of technical, clerical and contract administrative support, consistent with the level currently provided by District staff for the administration of FY 1991-92, 1992-93 and 1994-95 contracts, in an amount not to exceed $320,200. Additionally, technical support will also be provided by the Technology Advancement office at the half-time level of a Program Supervisor in an amount not to exceed $60,508.

The MSRC's contract with Science Applications International Corporation (SAIC) for Consultant Advisor services for FY 1993-94 contracts expired June 30, 1995. Hence, the District will assume contract administration responsibilities for FY 1993-94 contracts in addition to the administration of FYs 1991-92, 1992-93 and 1994-95 contracts which had been assumed earlier in the year for a total of 83 prior-year contracts. To allow the District to meet contract administration needs along with the start-up activities of the two-year FY 1995-97 Work Program, which includes at minimum one Request for Qualifications, one Informational Notice and seven Requests for Proposals, on June 22 the MSRC also committed additional monies to provide outside technical and contract administrative support.

Two contractors will be secured through sole-source agreements as part of the FY 1995-96 AB 2766 Discretionary Work Program. The MSRC proposes to retain Ray Gorski, who served as the Consultant Advisor through SAIC, to provide enhanced technical support for an amount not to exceed $80,000 at an hourly rate of $50. The enhanced contract administrative support will be provided by Doris Moore, also formerly with SAIC who had assisted in MSRC contract administration, for an amount not to exceed $46,750 at the hourly rate of $25 or less. Such agreements will provide continuity to the program. Both contracts will be for the period July 1, 1995, through June 30, 1996, and will be paid directly from the AB 2766 Discretionary Fund.

In accordance with Section II, Step 3(C) of the District's Consultant Selection Policy and Procedures, it is in the best interests of the District and the MSRC to seek sole-source contracts with Mr. Gorski and Ms. Moore because of their unique experience and knowledge of the AB 2766 Discretionary Fund Program and the need for immediate enhanced technical and contract administrative support which they alone can provide at this time.

However, Health & Safety Code Section 44244(b)(2) stipulates that the District Governing Board shall approve all parts of the annual Work Program. Consequently, the MSRC is requesting that the District Board approve these two contractors as part of the FY 1995-96 AB 2766 Discretionary Work Program.

The Administrative Committee reviewed this recommendation on June 23, 1995.

THEREFORE, IT IS RECOMMENDED THAT THE BOARD

--Approve the award of two sole-source contracts to provide enhanced technical and contract administration services as part of the FY 1995-96 AB 2766 Discretionary Work Program; and

--Authorize the Chairman to execute a sole-source contract with Ray Gorski in an amount not to exceed $80,000 for technical support for the FY 1995-97 Work Program and a sole-source contract with Doris Moore in an amount not to exceed $46,750 for contract administration for the FY 1995-97 Work Program.
