Recommendation for Preliminary Approval of the Transportation Conformity Memorandum of Understanding


The Board adopted Rule 1902 - Transportation Conformity in September 1994. Rule 1902 codifies the federal transportation conformity requirements in the South Coast Air Quality Management District. At the time of adoption, AQMD staff was participating in a regionwide effort to develop a Memorandum of Understanding (MOU) which would set forth the requirements for interagency consultation as specified in the federal transportation conformity rule. The adopting resolution for Rule 1902 specified that Subdivision (f) of the rule would be replaced with the MOU once all parties had signed it. The MOU is now ready for signature by the AQMD as the representing local air district The MOU will then be forwarded to the Air Resources Board (ARB) to obtain the remaining signatures from the Environmental Protection Agency (EPA), Federal Highway Administration, and Federal Transit Administration. As soon as all signatures have been obtained, the AQMD will promptly begin the amendment process for Rule 1902 and subsequently for the State Implementation Plan.

The Transportation Conformity MOU addresses policies and procedures on interagency consultation, public involvement, and conflict resolution. In addition, the MOU outlines the roles and responsibilities of the various public agencies in the development process of the regional transportation plan, transportation improvement program, transportation projects, and conformity analyses.

Staff of the below listed public agencies worked together to complete the MOU: AQMD, SCAG, ARB, EPA, Caltrans (Headquarters and Districts 7, 8, 11, and 12), and the county transportation commissions--Los Angeles County Metropolitan Transportation Authority, Orange County Transportation Authority, San Bernardino Associated Governments, and Riverside County Transportation Commission.

The Transportation Conformity MOU was reviewed and approved by the Mobile Source Committee on September 15, 1995.

THEREFORE, IT IS RECOMMENDED THAT YOUR BOARD

--Approve the attached Transportation Conformity MOU.

--Direct the Executive Officer to schedule a public hearing to revise Rule 1902 when all necessary parties have signed the MOU.
