PROPOSAL:
Award Sole Source Contract to County of Los Angeles for Communications Site License Support
SYNOPSIS:
AQMD's radio communication system supports the broadcast of air quality information and provides real time communication between headquarters and field inspection staff. A previous sole source contract with the County of Los Angeles to lease standard radio rack and antenna space(s) for radio communications purposes only at multi-user communication sites has expired. The proposed sole source contract continues this previous Communication Site License rental agreement with the County of Los Angeles through February 28, 2001 for an amount not to exceed $96,300.

RECOMMENDED ACTION:
Authorize the Chairman to execute a contract with County of Los Angeles for Communications Support Services at the annual rate of $19,260 for a total amount not to exceed $96,300 for five years.

Background
For the past twelve years, AQMD's radio communication system has supported the broadcast of daily air quality forecasts, health advisories, and alerts to schools, industries, media and other episode receivers located in the South Coast Air Basin, provided real time communication between headquarters and field inspection staff, and facilitated emergency incident response communication. AQMD first contracted with the County of Los Angeles for a Communications Site License to lease radio rack and antenna space(s) during Fiscal Year 1984-85. The most recent contract for these services was initiated in January 1990 with a term of five years. During 1995, this contract was extended until new contract terms could be agreed upon by AQMD and County of Los Angeles. The sole purpose of the proposed rental agreement is to allow the exclusive use of standard radio rack and antenna space(s) for AQMD radio communication purposes only at the following multi-user communication sites owned, operated and maintained by County of Los Angeles:
(1) Eastern Avenue Microwave Communication Site, Los Angeles;
(2) Hauser Peak Communication Site, Acton;
(3) County Courthouse, Pasadena; and
(4) Rolling Hills Transmitter Site, Rolling Hills.
The term of this license is five (5) years commencing March 1, 1996 and ending February 28, 2001 at a total cost not to exceed $96,300. Negotiating this contract annually would be more costly; negotiating for a five-year term enables the AQMD to secure reduced communication rental site rates. AQMD reserves the right to cancel this License or cease operation on one or more sites upon giving thirty (30) days' prior written notice to the County of Los Angeles.
Sole Source Justification
Section II, Step C(3) of the Consultant Selection Policy and Procedure identifies four provisions under which a sole-source bid may be justified: (1) cost to prepare documents exceeds cost for consultant, (2) delay would result in the endangerment of public health, (3) services are only available from sole-source, (4) other circumstances exist identifying sole-source as in the best interests of the AQMD. This request for sole-source bid is made under provision (3). The County of Los Angeles is the only provider of this type of service. AQMD's radio communication capability depends on utilizing the County of Los Angeles facilities.
Resource Impacts
Sufficient funds are available in the FY 1995-96 budget and it is expected that future budgets will contain sufficient resources as well.
