This report highlights AQMD rulemaking activity for 1997 and beyond. Upcoming public workshops are noted, both in the regular calendar and in a separate list at the end of the report.

Changes Since Last Forecast

The following is a brief summary of the scheduling changes which have occurred since last month’s forecast.

Proposed Rule 1105.1 - Control of PM10 from Fluid Catalytic Cracking Units (FCCU)

Proposed Amended Rule 1107 - Coating of Metal Parts and Products

Proposed Amended Rule 1173 - Fugitive Emissions of Volatile Organic Compounds

These were scheduled for adoption in September (1105.1), November (1173), and December (1107), 1997. Staff analysis indicates that additional time is required for technological developments in the metal products coatings category subject to Rule 1107 before emission reductions can be achieved in a cost-effective manner. Therefore, this item is now forecasted for hearing in 2000 and the staff assessment of the current state-of-technology will be submitted to the Governing Board prior to the end of this year. Regarding Rules 1105.1 and 1173, work is in progress to further reduce emissions of PM10 and VOC, respectively. However, additional time is necessary to complete the evaluation of test results and inventory and cost data before considering amendments to these rules, both of which are now forecasted for a date to be determined in 1998.

Rule 444 - Open Fires

This rule has been rescheduled for amendment from September 1997 to February 1998. Staff are continuously working with various source representatives to establish amended rule language that more clearly represents vegetation management and ordinance and pyrotechnic disposal practices.

Rule 1613 - Credits for Truck Stop Electrification

Rule 1624 - Credits for Clean Pleasure Craft Engines

Reg. XXV - Intercredit Trading

Proposed Rules 1613 and 1624 were initially scheduled for adoption in October. Additional staff discussions with potential users are needed. Therefore, these rules are delayed to November. Proposed Regulation XXV, originally targeted for hearing in September, has been delayed to December to provide the AQMD staff additional time to work with the public to resolve design issues.

In the next month’s forecast report, staff will seek to reassess the balance of rule activities for the remaining months of 1997 and early 1998, and prepare adjustments to better spread the work load among available hearing dates.

212 Standards for Approving Permits

Proposed amendments will revise public notice requirements for permit issuance, eliminate duplicative noticing requirements, and modify the notice distribution distance to comply with current legal noticing requirements for hazardous air emissions for facilities which require air permits and are located near schools.

Reg. XXX Title V

Proposed amendments will improve clarity, increase flexibility and enhance enforceability of the program and subsequent permits issued. Amendments will also reduce the number of facilities required to obtain a Title V permit and streamline procedures for public, affected state and USEPA reviews.

463.1 Control of Emissions from Storage of Organic Liquids (CM# FUG-03)

Proposed rule will take the first step of a two-step approach to reduce VOC emissions from organic liquid storage tanks by gathering data on storage tanks that are currently exempt from Rule 463 to assess the need for, or the level of, any future controls required to reduce VOC emissions from these tanks. If the data demonstrates a need to reduce VOC emissions, a step two rule will be proposed to include identification of the appropriate control options.

1110 Emissions from Stationary Internal Combustion Engines (Demonstration)

This rule is to be rescinded.

1110.2 Emissions from Gaseous- and Liquid-Fueled Internal Combustion Engines

Proposed amendments will consolidate the above rules to update emission limits and other requirements; eliminate duplicate or obsolete language; reflect requirements of USEPA non-road engine rulemaking; establish consistency with CARB statewide engine registration program and Rule 2100; and address AQMP control measure CMB-F.

Proposed amendments will delete obsolete language; clarify administrative requirements for non-RECLAIM continuous emissions monitoring systems (CEMS); and delete CEMS performance specifications.

Proposed rule will revise and identify specifications for non-RECLAIM CEMS to meet AQMD requirements for approval.

Proposed amendments will address the availability of CARB-certified vapor recovery systems for mobile fuelers and clarify any inconsistencies between rule language and the requirements of AB2243, and reflect changes necessary for implementation of the self-inspection and testing program.

1118 * Emission Reductions from Refinery Flares (CM# CMB - 07)

Proposed rule will take the first step of a two-step approach to potential flare emissions reduction by gathering data on flaring operations at petroleum refineries to assess the need for, or the level of, any future controls to reduce flare emissions. This first step will require refineries to monitor flaring activities for the amount and composition of gases being flared. If the data demonstrates a need to control flaring operations, step two of the rule will be to develop specific control requirements to reduce flare emissions.

Regulation XVIII will establish the structure for "Local Program Approval" for all Title III rules, including equivalency coverage of: emission sources, hazardous air pollutants, emission limits, and criteria for practical and enforceable monitoring, recordkeeping and reporting. Other rules that may need to be amended include Rules 108, 109, 461, 462, 463, 464, 466, 477, 481, 1101, 1106, 1124, 1125, 1126, 1129, 1130, 1130.1, 1136, 1141, 1142, 1162, 1173, 1176, 1179, 1401, 1402, 1405, 1406, and 1420.

Reg. XXX * Title V Operating Permits

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. On August 29, 1994, U. S. EPA proposed revisions to regulations that define the minimum elements of an approvable operating permit program. These regulations are expected to be finalized in 1997. Regulation XXX will then be amended to parallel changes in the EPA program.

Work is in progress to further reduce emissions of VOCs. However, additional time is necessary to complete the evaluation of test results and inventory and cost data before considering Proposed Amended Rule 1173.
