This report highlights AQMD rulemaking activity for 1997 and beyond. Upcoming public workshops are noted, both in the regular calendar and in a separate list at the end of the report.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMDs rulemaking and control measure implementation schedule. Rulemaking is a dynamic process, subject to ongoing revision. Scheduling changes which occurred since last months forecast are summarized.
Rules to be Rescheduled

Rule 461 - Gasoline Transfer and Dispensing) |
|
Rule 461 is rescheduled from February 1998 to April 1998 to allow staff to implement a short-term action plan to address issues from the recent audit of the self-compliance program. An April hearing will allow consideration of the results from some of the short-term action items, including frequency of inspection and recertification testing. The amendments will also modify rule language to be consistent with the requirements of AB2243. |

Reg XX - RECLAIM |
|
Reg. XX is rescheduled from April 1998 to July 1998 allow additional time for staff to meet with industry representatives to address CEMS certification issues regarding low concentration and low stack flow rate. Staff also needs additional time to evaluate the appropriateness of allowing separate frequency for RATA tests of concentration and stack flow rate where sources share fuel analyzer for sulfur content. |

MON-09 - In-Use Vehicle Emission Mitigation |

This AQMP control measure is rescheduled from March 1998 to August 1998 to allow staff additional time to address feasibility study results needed in the development of the rule. |

Rule 1169 - Hexavalent Chromium - Chrome Plating and Chromic Acid Anodizing |
|
Rule 1169 is rescheduled from April 1998 to June 1998. Proposed amendments will incorporate the requirements of the ATCM (NESHAP equivalent). CARB has rescheduled the ATCM Board Hearing to April 1998. Rule 1169 will be scheduled for proposed amendment to no later than 60 days after CARB has amended the ATCM. |

Rule 1437 - Furniture Stripping Operations |
|
Rule 1437 is rescheduled from April 1998 to September 1998 to allow staff additional time to incorporate results from an AQMD contract and those from a NIOSH contract due in May 1998. |

Rule 1140 - Abrasive Blasting |
|
Rule 1140 is rescheduled from June 1998 to August 1998. Rule 1169 will be scheduled for proposed amendment to no later than 60 days after Department of Toxics Substances Control has adopted their new state rule. |

Title III - Title III Program & Regulation XVIII |
|
Title III is rescheduled from July 1998 to December 1998. EPA has delayed amending their Subpart E regulations for Section 112(1) - Local Program Approval of the 1990 Clean Air Act Amendments to April 1998. Title III amendments will depend on what EPA will allow in their revisions. |

If the data demonstrates a need to control flaring operations, step two of the rule will be to develop specific control requirements to reduce flare emissions. New Source Review of Carcinogenic Air Contaminants Rule 1401 sets threshold risk levels based on cancer risk and estimated cancer cases for new equipment and equipment that is modified or relocated. Control of Toxic Air Contaminants from Existing Sources Rule 1402 requires facilities with significant risks for cancer and non-cancer acute and chronic hazards to file and follow risk reductions plans which will reduce risks below specified levels within 5 years. As part of the Chairmans Environmental Justice Initiatives, the list of compounds included in Rule 1401 and the toxics significance thresholds in Rule 1401 and Rule 1402 will be evaluated, as well as other approaches to reduce toxic risk.
