Background

AQMD is required by state law to publish a list of all rules potentially scheduled for consideration during the coming year. At the January 1997 Board Meeting, the Rule Forecast Report was expanded to present a progress report to the Board. Four additional rules are being added to this report: Rule 518.2 - Federal Alternative Operating Conditions, and Rules 1110, 1110.1 and 1110.2 for Emissions from Internal Combustion Engines. Although these rules were not in the January 1997 Rule Forecast Report, amendments to these rules are necessary to preserve the original intent of the rules as stated upon their adoption. The proposed amendments to Rules 1110, 1110.1 and 1110.2 are also necessary to meet federal requirements.

This report highlights rulemaking activities for 1996 and forecasts emission reductions due to proposed rulemaking activities in 1997.

VOC Emission Reductions for 1996

1996 VOC emission reductions came primarily from amendments to Rule 1171 - Solvent Cleaning Operations, Rule 1113 - Architectural Coatings, and Rule 1176 - Wastewater Systems.

Rule Relaxations

1996 Amendments to Rule 1136 - Wood Furniture Coatings, Rule 1113 - Architectural Coatings, Rule 1130.1 - Screen Printing and Rule 1124 - Aerospace Coatings have impacted the expected level of emission reductions further by eliminating or postponing adopted compliance dates and, hence, emission reductions, into future years.

Emission Reductions for 1997

The proposed rule adoption schedule for 1997 is intensive in scope and nature. Twenty-three proposed rules need to be adopted and implemented as scheduled to maintain our progress towards clean air and to meet the attainment deadlines established in state and federal laws.

212 Standards for Approving Permits

& Reg. XXX Title V

Proposed amendments will revise public notice requirements for permit issuance, eliminate duplicative noticing requirements, and modify the notice distribution distance to comply with current legal noticing requirements for hazardous air emissions for facilities which require air permits and are located near schools.

Proposed amendments will improve clarity, increase flexibility and enhance enforceability of the program and subsequent permits issued. Amendments will also reduce the number of facilities required to obtain a Title V permit and streamline procedures for public, affected state and USEPA reviews.

1421 Control of Perchloroethylene Emissions From Dry Cleaning Systems This rule is proposed for recision. If rescinded, it will be replaced by the statewide airborne toxics control measure regulating dry cleaning systems.

463 Storage of Organic Liquids (CM# FUG-03) Proposed amendments will take the first step of a two-step approach to reduce VOC emissions from organic liquid storage tanks by gathering data on storage tanks that are currently exempt from Rule 463 to assess the need for, or the level of, any future controls required to reduce VOC emissions from these tanks. If the data demonstrates a need to reduce VOC emissions, step two of the rule will include identification of the appropriate control options.

1118 * Emission Reductions from Refinery Flares (M# CMB - 07) Proposed rule will take the first step of a two-step approach to potential flare emissions reduction by gathering data on flaring operations at petroleum refineries to assess the need for, or the level of, any future controls to reduce flare emissions. This first step will require refineries to monitor flaring activities for the amount and composition of gases being flared. If the data demonstrates a need to control flaring operations, step two of the rule will be to develop specific control requirements to reduce flare emissions.

XXX * Title V Operating Permits Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. On August 29, 1994, U. S. EPA proposed revisions to regulations that define the minimum elements of an approvable operating permit program. These regulations are expected to be finalized in 1997. Regulation XXX will then be amended to parallel changes in the EPA program.
