Proposal:

Establish Advisory Committee to Review RECLAIM Progress Report

Synopsis:

Pursuant to California Health and Safety Code Section 40440.2, the Board shall establish an advisory committee on or before July 1, 1997. The committee shall be established for the purpose of reviewing the RECLAIM progress report for the first three years of program implementation, to be submitted to the Board by July 1, 1998. The advisory committee will serve a maximum of one year or until the progress report is made to the Board. The Health and Safety Code further specifies that this advisory committee be composed of representatives from specified industries and types of institutions. A proposed list of advisory committee members has been prepared for Board approval.

Establish a RECLAIM Advisory Committee to review the RECLAIM progress report and appoint members, as recommended herein, to serve for a term of one year commencing July 1, 1997.

Background

Health and Safety Code Section 40440.2 specifies that AQMD present a RECLAIM progress report to the Board on or before July 1, 1998 and, further, that the Board, on or before July 1, 1997, select an advisory committee to conduct a peer review of the RECLAIM progress report for the first three years of RECLAIM implementation. The law also requires the advisory committee to present its peer review conclusions to your Board as an independent report concurrent with staff’s report. The advisory committee will serve a maximum of one year or until the progress report is made to the Governing Board, whichever is later. The statute also specifies the composition of the advisory committee, as follows:

One representative each from:
a RECLAIM facility which emits more than 100 tons of NOx or SOx annually;
a RECLAIM facility which emits from 11 to 100 tons of NOx or SOx annually;
a RECLAIM facility which emits less than 10 tons of NOx or SOx annually;
AQMD staff;
ARB staff;
EPA staff
a financial institution;
an academic institution;
a market commodities or securities trading institution;
an economic analysis research institution;
each of the investor-owned energy utilities serving the basin;
a municipal energy utility representing the City of Los Angeles;
a technical contractor specializing in installation and certification of emissions monitoring equipment;
an oil company;
the aerospace industry; and
Two representatives from: environmental organizations.

Proposal

A table proposing representatives for each of the categories identified in the statute, as well as the organizations they represent and their telephone numbers, is attached for the Board’s consideration and approval. The proposed advisory committee membership is composed of individuals who were active in the development of the RECLAIM program and who have worked with staff on the resolution of various implementation issues which have arisen. Therefore, these individuals possess the background and experience to assist AQMD in presenting an accurate and meaningful progress report to your Board.

Legal Mandates

As discussed above, Section 40440.2 of the Health and Safety Code mandates the establishment of a RECLAIM advisory committee no later than July 1, 1997. This committee shall serve for a maximum period of one year or until the RECLAIM progress report upon which the advisory committee shall conduct a peer review is made to your Board, whichever is later.
