Set forth below is a summary of key issues addressed at the MSRC’s April 24, 1997 meeting. The next MSRC meeting is Thursday, May 22, 1997, at 1:00 p.m. in AQMD Conference Room CC8.

Minutes

The minutes of the March 27, 1997, monthly meeting were approved, with minor amendments. These minutes are provided for your information as Attachment 1.

Two-Year FY 1997-99 AB 2766 Discretionary Fund Work Program

On February 27, 1997, the MSRC unanimously approved the elements of the FY 1997-99 AB 2766 Discretionary Fund Work Program, including the application process for the Local Government/AB 2766 City Subvention Match Program. On March 27, 1997, the MSRC unanimously approved the two RFPs for the TCM Smart Shuttle and Research & Development Programs. On April 24, 1997, the MSRC unanimously approved two more RFPs within the $2.5 million TCM element of the Work Program. They are as follows:

1) RFP #9697-49 Market-Based Incentive Programs to solicit proposals for projects that cost-effectively demonstrate one or of the following strategies with a one-year minimum demonstration period:

2) RFP #9697-50 Student Education Projects to solicit proposals that educate pre-driving youth in primary and secondary school grades about the social and environmental impacts of traffic congestion and unhealthful air quality through:

These two RFPs have been included on our May 9, 1997 Governing Board agenda for consideration. A Bidders’ Conference is scheduled Wednesday, May 21, 1997, at 8:30 a.m. in the Auditorium to review these two RFPs along with the two approved in April and the Local Government/AB 2766 City Subvention Match Program. A Technical Workshop will follow on Wednesday, May 28, at 9:00 a.m. in Room 1G. The MSRC also approved a brochure on these two RFPs for distribution to the 1,800+ interested parties on the AB 2766 mailing list, and a copy of the brochure can be obtained by calling the MSRC’s toll-free number (1 800 HLP-2766).

Projects Approved for the EV Corridor Community Program;

Part of the FY 1995-97 AB 2766 Discretionary Work Program

The MSRC’s FY 1995-97 AB 2766 Discretionary Work Program included a $7 million ZEV "Quick Charge" Program composed of three parts--an Outreach Coordinator, a Manufacturers’ Buydown Incentive, and an EV Corridor Community Program. Funding for the EV Corridor Community Program was originally allocated at $1.675 million. However, the EV Subcommittee and MSRC-TAC recommended funding projects at $1,729,581, using the original funds allocated plus turn-back funds from projects that either realized cost savings, were reduced in scope and funding, or could not go forward as planned. On April 24, 1997, the MSRC unanimously approved several projects for the EV Corridor Community Program, and the funding recommendations have been included on our May 9, 1997 Governing Board agenda for consideration. The Program will ensure deployment of EVs by providing the necessary infrastructure, including coordination with utilities and manufacturers, to support these vehicles, and will result in 137 charging sites with 437 charging stations throughout the four-county area within the AQMD’s jurisdiction. I will keep you posted on the results of this Program.

Advertising Policy and Outreach

Last month the MSRC adopted an interim policy to advertise its funding opportunities in conjunction with other AQMD procurement opportunities, while reimbursing the AQMD for prorated costs for ads in the following publications (approximately $1,100 per advertisement):

Although the MSRC’s funding opportunities will continue to appear in conjunction with AQMD opportunities in 14 additional publications targeted at minority communities, the AQMD will assume the cost for these efforts. The MSRC’s policy stems from its 5% administrative cap which cannot be exceeded by law. On April 24, a draft policy was presented to reimburse the AQMD for all advertising costs on an incremental rather than prorated basis. Details of the incremental-cost basis are being worked out between the Committee and staff, with the final policy to be included on the MSRC’s next agenda within its consent calendar. I will provide you a copy of this policy in my next monthly report on MSRC activities.

Further outreach is also conducted by the MSRC through bidders’ conferences, technical workshops, press releases, PSAs, and advertisements in journals and newsletter. In fact, a press release was issued on the FY 1997-99 Work Program following the April 11, 1997 Board meeting. In addition, the MSRC formed an Outreach Subcommittee to work with the AQMD’s Ad Hoc Affirmative Action Committee and the Ethnic Community Advisory Group to develop further outreach mechanisms by which broader participation can be encouraged.

Receive and Forward to the AQMD Board FYs 1993-94 and 1994-95 Audit of

AB 2766 Discretionary Fund

Staff presented audit findings from the FYs 1993-94 and 1994-95 AB 2766 Discretionary Fund to the MSRC. The audit questioned five issues relating to the MSRC’s FY 1993-94 ISTEA match program providing over $4 million funding to the four county transportation commissions. In three instances, the entities agreed with the audit findings and corrective action was taken. After further auditing, it was determined that the other two projects satisfied the contract intent of reducing emissions from motor vehicles and no further action is necessary. The MSRC unanimously recommended forwarding the report to the AQMD Board for our May 9, 1997 meeting.

Report to ARB on Motor Vehicle Fees for FY 1995-96 AB 2766 Subvention Fund

The MSRC was provided a presentation by staff on the Report to ARB on Motor Vehicle Fees for FY 1995-96 AB 2766 Subvention Fund. The revenue balance for the Subvention Fund has been reduced considerably from $22 million to $9 million due in part to AQMD’s assistance to cities on how to efficiently and effectively spend these funds by developing three- to five-year spending plans for city council adoption as well as improved accounting procedures which more accurately reflect monies committed but not yet encumbered by local governments. This report has been included on our May 9, 1997 Governing Board agenda for consideration.

Receipt and Approval of Final Reports

The MSRC received and approved two final reports. They are as follows:

1. City of Anaheim Contract #C95024, which provided $123,000 for a short-stop vanpool program; and

2. Southern California Association of Governments Contract #C95006, which provided $16,000 for a Hidden Cost of Automobile Ownership high school curriculum project.

All final reports for the AB 2766 Discretionary Fund Program are filed in the AQMD’s Library.

Contract Modification Requests

The MSRC took the following unanimous actions on requested contract modifications, as recommended by its Technical Advisory Committee:

1. For City of Torrance Contract #C96004, which provides $96,160 to develop and provide an Urban Trail System, approval of a seven-month contractual term extension;

2. For City of Torrance Contract #C97007, which provides $80,733 for a "Spokes for Folks" project, approval of a five-month contractual term extension;

3. For Omnitrans Contract #C95014, which provides $952,725 for the purchase of 21 CNG buses, approval of the deletion of the Victor Valley Transit Authority portion (Phase III) of the contract, with $86,250 to be returned to the Discretionary Fund;

4. For University of California Riverside/CE-CERT Contract #C96017, which provides $148,186 for a Goods Movement Emissions Analysis project, approval of a six-month contractual term extension;

5. For A-Z Bus Sales Contract #C95022, which provides $2,885,603 for 20 electric and 10 CNG buses, approval of a two-month contractual term extension, to resolve difficulties with the project and return to the MSRC in June for final resolution; and

6. For Riverside County Transportation Commission Contract #C96029, which provides $50,000 for a Work-End Fleet Demonstration project, approval to cancel contract because of minimal participation and higher costs than anticipated with $35,000 to be returned to the Discretionary Fund.

The MSRC was also informed that unfortunately the City of Newport Beach was returning its $500,000 award for the purchase of five CNG street sweepers because of vehicle procurement problems and cost escalations.

The MSRC also received and filed a "Report on Scope Changes Handled Administratively by the AQMD Contract Administrator" which included only one amendment for a minor cost reallocation for Waste Management of the Desert Contract #C95012, which provides $852,200 for repowering 14 waste trucks.

Contract Administrator Report

The MSRC's AB 2766 Contract Administrator provided a written status report on all fiscal year contracts. This Contract Administrator Report is also attached for your information (Attachment 2).
