SYNOPSIS:
This report highlights AQMD rulemaking activity for 1997 and beyond. Upcoming public workshops are noted, both in the regular calendar and in a separate list at the end of the report.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Rulemaking is a dynamic process, subject to ongoing revision. Scheduling changes which occurred since last month’s forecast are summarized.

Per the Governing Board’s direction, rule amendment efforts will be coordinated with the MATES II sampling program, since this information will be an integral part of the re-opened public comment on Rules 1401 and 1402. A coordinated work plan is being prepared. |
A summary (Attachment A) and individual technical assessments are attached for the following three rules, which are being recommended for deferral:
Rule 1173 - Fugitive Emissions of Volatile Organic Compounds
Additional inventory studies and evaluation of cost data are needed for this rule, which is recommended for consideration in August 1998. (See Attachment B)
Rule 1105.1 - Control of PM10 from Fluid Catalytic Cracking Units
Pending completion of recent test data analysis, and reevaluation of cost-effectiveness, staff recommends that this rule be deferred to November 1998. (See Attachment C)
Rule 463.1 - Control of Emissions from Storage of Organic Liquids
Revised inventory data shows a small potential for feasible emission reductions. Staff recommends that development of this rule be deferred and reconsidered in the 2000 AQMP. (See Attachment D)

Emission Reductions from Refinery Flares (CM# CMB - 07) Proposed rule will take the first step of a two-step approach to potential flare emissions reduction by gathering data on flaring operations at petroleum refineries to assess the need for, or the level of, any future controls to reduce flare emissions. This first step will require refineries to monitor flaring activities for the amount and composition of gases being flared. Title V Operating Permits Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. New Source Review of Carcinogenic Air Contaminants Rule 1401 sets threshold risk levels based on cancer risk and estimated cancer cases for new equipment and equipment that is modified or relocated. Control of Toxic Air Contaminants from Existing Sources Rule 1402 requires facilities with significant risks for cancer and non-cancer acute and chronic hazards to file and follow risk reduction plans which will reduce risks below specified levels within 5 years. As part of the Chairman’s Environmental Justice Initiatives, the list of compounds included in Rule 1401 and the toxics significance thresholds in Rule 1401 and Rule 1402 will be evaluated, as well as other approaches to reduce toxic risk.
