PROPOSAL:

Adopt Charter for and Establish Membership of Environmental Justice Task Force; Modify Charter for and Establish Membership of Local Government & Small Business Assistance Advisory Group; Delegate Authority to Make Additional Appointments From Time to Time; and Report Board Chair’s Appointment of Replacement Member to AQMP Advisory Group

SYNOPSIS:

The Board established an Environmental Justice Task Force (EJTF) as part of the Environmental Justice Initiatives. Also, the Board has previously reviewed existing advisory groups, consolidated functions into six advisory groups: AQMP; Ethnic Community; Home Rule; Local Government & Small Business Assistance; Scientific, Technical & Modeling Peer Review; and Technology Advancement, and established charters for each. This action is to (1) adopt the Charter for the EJTF and to establish its membership; (2) modify the Charter for and establish membership of the Local Government & Small Business Assistance Advisory Group; (3) delegate authority to the Board Chair or Vice Chair to make additional appointments from time to time, and (4) report the Chair’s appointment of a replacement member to the AQMP Advisory Group.

RECOMMENDED ACTION:

  1. Adopt Charter for and establish membership of the Environmental Justice Task Force;

  2. Modify Charter for and establish membership of the Local Government & Small Business Assistance Advisory Group in accordance with the attached list;

  3. Delegate authority to the Board Chair, or in the Chair’s absence, the Vice Chair to make additional appointments from time to time and report those appointments to the Board at the next Board meeting following the appointment; and

  4. Acknowledge the Chair’s appointment of a replacement member to the AQMP Advisory Group.

Background

Environmental Justice Task Force

At the October 10, 1997 meeting, the Board approved a workplan to implement the Environmental Justice Initiatives proposed by Chairman Burke. These included the establishment of an Environmental Justice Task Force. Staff committed to return to the November Board meeting with a mission statement and goals and objectives. These elements are included in the Charter for the Environmental Justice Task Force (Attachment A). Attachment B is the proposed membership of the EJTF.

Local Government & Small Business Assistance Advisory Group

At the January 10, 1997 meeting, the Board established charters for the six advisory groups specified in the synopsis above and the membership for five groups has previously been established by the Board. At the Administrative Committee meeting October 24, 1997, I recommended that the Charter be modified to clarify that the LG&SBA Advisory Group’s duties include reviewing and making recommendations on those rules most significantly impacting local government and small business. The Administrative Committee concurred and Attachment C is the LG&SBA Advisory Group charter reflecting that modification. The Committee further approved staff’s recommendations for membership on the LG&SBA Group as reflected in Attachment D.

Delegation of Appointment Authority

The Administrative Committee recommended that the Board delegate to the Board Chair or, in the Chair’s absence, the Vice Chair the authority to make additional appointments from time to time so that members can be added and participate in a timely fashion. These additional appointments would be reported to the Board at the next Board meeting following the appointment. This process was approved by the Board at its September and October meetings with respect to the other five Advisory Groups.

Report of Subsequent Appointment

Subsequent to the Board’s action to establish membership of the AQMP Advisory Group at its September, 1997 meeting, staff was informed that Mr. Mike Na is no longer affiliated with the Korean Dry Cleaners Association (KDCA) and Chairman Burke has approved the replacement appointment of Mr. Ok-Hwan Kim, Director of External Affairs for the KDCA.

Advisory Council

Now that membership of the six Advisory Groups have been established, the Advisory Council membership can be established. Staff anticipates bringing recommendations for membership to the December Board meeting, following review by the Administrative Committee at its November 21 meeting.

Proposal

  1. Adopt the attached Charter for the Environmental Justice Task Force, Attachment A, and establish the EJTF membership in accordance with Attachment B.

  2. Modify the Charter for the Local Government & Small Business Assistance Advisory Group, Attachment C, and establish its membership in accordance with attachment D.

  3. Authorize the Board Chair or, in the Chair’s absence, the Vice Chair to make additional appointments from time to time and report those appointments to the Board at the next Board meeting following the appointment.

  4. Acknowledge the Chairman’s replacement appointment of Mr. Ok-Hwan Kim representing the Korean Dry Cleaners Association as a member of the AQMP Advisory Group.

Fiscal Impacts

Existing staff resources will be reallocated to support the EJTF as well as the LG&SBA Advisory Group.
