This report highlights AQMD rulemaking activity for 1997 and beyond. Upcoming public workshops are noted, both in the regular calendar and in a separate list at the end of the report.

The Rule Forecast Report provides the Board with a monthly update of AQMD’s rulemaking schedule. Rulemaking is a dynamic process, subject to ongoing revision. Scheduling changes which occurred since last month’s forecast are summarized.

A public consultation meeting was held on Tuesday, September 30, 1997 at AQMD headquarters to solicit public comments regarding the feasibility of amending or adopting rules to reduce emissions from several categories. Rules discussed included existing Rule 1107 for metal coating industry and Rule 1173 for leaks from refinery valves, pumps and compressors; and newly proposed Rule 463.1 for small organic liquid storage tanks and Rule 1105.1 for PM10 control from refinery fluid catalytic cracking units. Public comment received at the meeting supported the general staff position that additional work is needed to determine if emission reduction can be achieved from these sources in a cost-effective and feasible manner. The Rule Forecast Calendar reflects the deferral of Board consideration for Rules 1173 and 1105.1 to 1998, and Rules 463.1 and 1107 to 2000, at which time staff will again seek input from the public regarding the development of the appropriate rule proposal.

Rules to be Rescheduled

Reg. 461 - Gasoline Transfer and Dispensing

This regulation is rescheduled from December 1997 to February 1998. Because of recent field audit findings of non-compliance there has been an immediate increase of inspection staff in the field. A full review of the workplan with recommendations will be presented to Stationary Source Committee on October 24, 1997. Staff are considering additional rule amendments to improve industry compliance and resolve any inconsistencies with state law.

CTS-04 - Public Awareness/Education Programs - Area Sources

This control measure is being moved to allow further time to develop educational programs. A July 1998 date is consistent with the 1997 AQMP implementation date.

Rule 1624 - Credits for Clean Pleasure Craft Engines (CM# CMB - 07)

This control measure is rescheduled from November 1997 to December 1997 to allow additional time for staff to work with industry representatives to determine cost effectiveness of implementation.

Proposed amendments will consolidate the above rules to update emission limits and other requirements; eliminate duplicate or obsolete language; reflect requirements of USEPA non-road engine rulemaking; establish consistency with CARB statewide engine registration program and Rule 2100; and address AQMP control measure CMB-F.

Enforceable Procedures for Applying Air Quality Investment Program (AQIP) Emission Reductions

Proposed Rule 2503 provides the enforceable procedures such as the calculation methodology necessary to determine the required amount of emission reductions, monitoring, recordkeeping, and reporting provisions when Regulation IV or XI sources elect to use Rule 2501 AQIP emission reductions.

Emission Reductions from Refinery Flares (CM# CMB - 07)

Proposed rule will take the first step of a two-step approach to potential flare emissions reduction by gathering data on flaring operations at petroleum refineries to assess the need for, or the level of, any future controls to reduce flare emissions. This first step will require refineries to monitor flaring activities for the amount and composition of gases being flared. If the data demonstrates a need to control flaring operations, step two of the rule will be to develop specific control requirements to reduce flare emissions.

Control of Toxic Air Contaminants from Existing Sources

Rule 1402 requires facilities with significant risks for cancer and non-cancer acute and chronic hazards to file and follow risk reductions plans which will reduce risks below specified levels with 5 years.

As part of the Chairman’s Environmental Justice Initiatives, the lists of toxics significance thresholds in Rule 1401 and 1402 will be evaluated as well as other approaches to reduce toxic risk.

Proposed amendments will address SIP recommendations identified by US EPA; consider lowering leak thresholds for minor and major gas leaks; require the use of trained individuals for leak inspections; consider the new federal NESHAPs requirements; and address other issues regarding implementation of inspection and maintenance. Work is in progress to further reduce emissions of VOCs. Title V Operating Permits

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. On August 29, 1994, U.S. EPA proposed revisions to regulations that define the minimum elements of an approvable operating permit program. These regulations are expected to be finalized in 1997. Regulation XXX will then be amended to parallel changes in the EPA program.
