Approve Compensation Package for Designated Deputy
SYNOPSIS:
The current Executive Management Agreement for Oscar F. Abarca expires May 1, 1998. The Acting Executive Officer proposes to execute a new contract with Mr. Abarca and this action is to approve the compensation package.

The Executive Management Agreement with Oscar F. Abarca, which previously was extended from its expiration date of January 31, 1997, expires May 1, 1998. There are two Intergovernmental Affairs Directors responsible for a full range of local government assistance -- Mr. Abarca, whose primary area of responsibility is Los Angeles County, and Mr. Rhinehart who handles the Inland Empire and Orange County.
Since January 31, 1997 and to the present, Mr. Abarca has performed his duties accordingly. During the first five months, Intergovernmental Affairs reported to the DEO of Technical Support Services and administered the AB 2766 Subvention Fund, managed the Public Records Unit and served as a liaison for local governments and constituent related problems.
Under the DEO of Public Affairs since June 3, 1997, Mr. Abarca has performed several programmatic duties as well as managed the Public Records Unit since its transition from Chief Prosecutors Office to Public Affairs and Local Government Assistance. One of the most effective projects will be an updated guide-book for local governments receiving AB 2766 Subvention Funds. Mr. Abarca is preparing to take this document to the AQMD Board in late Spring, 1998. Mr. Abarca also has managed the technical assistance contract for the AB 2766 Subvention fund program and serves as the liaison between the District and the ARB AB 2766 Interagency task force. Mr. Abarcas responsibilities have also included outreach efforts for Los Angeles County cities and district offices for both State and Federal officials.
Mr. Abarca has performed very capably as Intergovernmental Affairs Director. The Acting Executive Officer recommends that the Board approve the compensation package for Oscar F. Abarca, effective May 2, 1998 for a term ending July 31, 2001, increase salary by four percent to $81,961, and increase to 75% the employer contribution rate for the Section 457 deferred compensation retirement program. The proposed Executive Management Agreement is attached. Also attached is an underline/strikeout version of the Agreement showing the changes to Mr. Abarcas 1993 contract. With the exception of the salary amount, the changes solely incorporate the new contract boilerplate approved by the Board on June 13, 1997.
Fiscal Impacts
Sufficient funds are budgeted each fiscal year for salaries and benefits.
