PROPOSAL:

Amend Technical Guidance Document for Regulation XXX - Title V Permits

SYNOPSIS:

The Technical Guidance Document (TGD) provides an explanation of the Title V program and simple guidelines for facilities applying for Title V permits. The document also contains application forms for Title V permits which require EPA approval for program implementation. Staff has revised the TGD consistent with recent changes to Regulation XXX adopted by the Board on November 14 and December 12, 1997.

Background

Title V of the 1990 amendments to the federal Clean Air Act required EPA to establish a national operating permit program. In 1992, EPA published regulations requiring AQMD and other air pollution control agencies across the country to develop and implement a federal operating permit program that complies with the federal regulationssubmit the program to EPA for approval, and upon approval, implement the program. The AQMD’s Title V program, Regulation XXX - Title V Permits, was adopted on October 8, 1993 and later amended on August 11, 1995, November 14, 1997, and December 12, 1997.V program interim approval on February 27, 1997 and the program was authorized to begin on March 31, 1997. Now the AQMD has 18 months to make certain required revisions to Regulation XXX to obtain full approval as well as to comply with state law. The first round of amendments were adopted by the Governing Board on November 14, 1997.

Facilities subject to Title V have begun to apply for a Title V permit. These facilities will also be required to comply with specific Title V procedures for modifying their permit in the future. permits to one-third of the affected facilities each year. A draft version of The Technical Guidance Document (TGD) was developed to assist the public and 1995 as an aid to introduce the Title V facilities in understanding the requirements of the Title V program. It will also help facility owners and operators understand how to apply for a Title V permit and maintain compliance with it. The first TGD, Version 1.0, was received and filed by the Governing Board at the January 1997 Board meeting. This document was provided to reflect the changes made to Regulation XXX in August 1995, in December 1996, the TGD was subsequently rewritten and reformatted to make the document more user-friendly in providing guidance in implementing this new program. Then in Staff mailed aA slightly revised mailed to the first group of Title V applicantsions mailed out in April 1997 to assist them in the preparation of their application package. Staff hasaffected by anticipated proposed changes to Regulation XXX. Because additional these anticipated amendments to Regulation XXX were adopted by the Governing Board in November 1997, the TGD must be updated the TGD to reflect the amendments to Regulation XXX - Title V Permits, adopted by the Governing Board in November and December, 1997.

This revised TGD (Version 2.0) will continue to provide facilities with Title V application forms and to assist facilities and the public in answering the following questions:

How does a facility determine if Title V applies?
How does a facility get excluded or exempted from Title V?
What is a Title V permit?
How does a facility apply for and obtain a Title V permit?
What forms are needed to apply for and obtain a Title V permit?
How does a facility revise its Title V permit if there is a change at the facility?
What does a facility need to do to demonstrate compliance with Title V?
How can the public participate in the Title V permit process?

In accordance with the November 14, 1997 and December 12, 1997 amendments to Regulation XXX, there are significant changes to the TGD in the areas of applicability determination, permit revision process, permit review process, and permit content. AQMD will continue to periodically update this document in response to new information or changes in the Title V program.
