This report highlights AQMD rulemaking activity for 1998. Upcoming public workshops are noted, both in the regular calendar and in a separate list at the end of the report.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Rulemaking is a dynamic process, subject to ongoing revision. Scheduling changes which occurred since last month’s forecast are summarized:

Rules to be Rescheduled/Removed

Rule 1437 – Furniture Stripping Operations

Proposed Rule 1437 is rescheduled from September 1998 to December 1998 to ensure that the rule approach is consistent with Rule 1401 and to explore the development of a product rule to address small ubiquitous uses of methylene chloride. Additional time is needed to conduct additional studies to evaluate further enhancements to the ventilation system to lower cancer risk at specific companies and collecting more data on distribution of companies by methylene chloride usage. Additional time is also needed for the assessment of results from the study on furniture stripping operations conducted by consultant.

Rule 2202 – On-Road Motor Vehicle Mitigation Options

Proposed Amended Rule 2202 is added to the October schedule.

Rule 1173 – Fugitive Emissions of Volatile Organic Compounds (CM #97 FUG-04)

Proposed Amended Rule 1173 is rescheduled from August 1998 to December 1998. Additional time is needed for further analysis of data and discussions with affected parties.

Rule 462 – Organic Liquid Loading

Proposed Amended Rule 462 is rescheduled from October 1998 to December 1998. Additional time is needed for further analysis of data and discussions with affected parties.

Rule 461 – Gasoline Transfer and Dispensing

Proposed Amended Rule 461 is rescheduled from September 1998 to October 1998. Staff is implementing a Rule 461 Action Plan to address the unacceptable non-compliance levels at retail gasoline dispensing facilities. Staff is inspecting all stations to identify those components or systems that are most prone to failure and assessing the efficacy of the self compliance program. In addition, the results of the required compliance tests are under review to assess whether or not testing requirements should be modified. The CARB has identified certain certified systems and components with design defects and is formulating corrective measures for those deficiencies. Rescheduling of the hearing is necessary to allow the findings of AQMD and CARB staff to be included in the rulemaking.

Rule 1158 – Storage, Handling, and Transportation of Petroleum Coke

Proposed Amended Rule 1158 is rescheduled from September 1998 to October 1998. Additional time is needed for further analysis of data and discussions with affected facilities, and to enable staff to research additional requirements needed in the amendment of the rule.

Rule 218 – Continuous Emissions Monitoring

Rule 218.1 – Continuous Emission Monitoring Performance Specifications

The Proposed Amended Rule 218 and Proposed Rule 218.1 are rescheduled from August 1998 to September 1998. Staff is recommending a month delay to allow affected industries additional time to comment on recent changes to proposed rule language, and to allow staff to evaluate and respond to those comments. Although these rules are administrative in nature, they address complex technical issues associated with CEMS and will require additional time for regulated facilities to fully evaluate the proposed changes.

Proposed amendments will implement CM #97CTS-02H of 1997 AQMP which called for emission reductions of 4.9 tons/day by 2010. This proposal will likely realize smaller emission reductions due to decreased VOC emissions inventory and a more focused target of sources for emissions reductions.

Definition of Minor Violation and Guidelines for Issuance of Notice to Comply

Effective January 1, 1996, AB 2937 (Brulte) required each air district in the state of California to develop a rule governing issuance of a Notice to Comply for minor violations. A CAPCOA task force was convened that year to draft core rule language for adoption by all districts statewide, subject to minor local modifications as required. Following numerous public consultation meetings held throughout the state in 1997, comments were evaluated and rule language modified as necessary. Proposed Rule 112 - Definition of Minor Violation and Guidelines for Issuance of Notice to Comply represents the culmination of this effort to meet the requirements of AB 2937.

Equipment Not Requiring a Written Permit Pursuant to Regulation II

Proposed amendments delete written permit requirements for equipment found to emit negligible amounts of air contaminants or equipment regulated by federal or state air emission standards. Amendments may also add written permit requirements for equipment found to emit significant amounts of air contaminants.

Filing Requirements for Non-Permitted Equipment

Proposed rule will require some equipment that is currently exempt or proposed for exemption from permit under Rule 219 to register certain information with the AQMD to help facilitate compliance and outreach efforts. An annual update and compliance certification is being proposed. Charbroilers and other equipment are being considered for this program.

Visible Emissions

An exemption is being considered for charbroilers. This equipment would still be subject to the states’ opacity limits.

Promotion of Catalyst-Surface Coating Technology Programs for Air Conditioning Units

Proposed rule will promote use of catalyst-surface coating technologies in residential and commercial air conditioning units. Catalyst surface coating may possibly be a required element for new sources or be included as a recommendation in AQMD’s CEQA Handbook.

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. These regulations may be finalized in 1998; if so, then Regulation XXX would be amended to parallel changes in the EPA program.

Control of Toxic Air Contaminants from Existing Sources

Rule 1402 requires facilities with significant risks for cancer and non-cancer acute and chronic hazards to file and follow risk reduction plans which will reduce risks below specified levels within 5 years.

As part of the Chairman’s Environmental Justice Initiatives, the list of compounds and the toxics significance thresholds in Rule 1402 will be evaluated, as well as other approaches to reduce toxic risk.

New Source Review of Toxic Air Contaminants

Both Rules 1401 and 1402 will be evaluated for possible amendments to address cumulative impacts from air toxics.
