The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Rulemaking is a dynamic process, subject to ongoing revision. Scheduling changes which occurred since last month’s forecast are summarized:

Rules to be Rescheduled/Removed

MSC-02 – In-Use Compliance Program for Air Pollution Control Equipment

Proposed Control Measure MSC-02 is rescheduled from July 1998 to November 1998. Guidelines and requirements will be established for manufacturers and suppliers to guarantee the performance of air pollution control equipment for a specific time period. Additional time is needed to secure the necessary information from manufacturers and suppliers. Implementation of this control measure should result in emission reductions through maintaining high efficiency performance (as guaranteed by the manufacturer/supplier) of the control equipment. Emission inventories and potential emission reductions will be determined during the development of this control measure.

Rule 1610 – Old Vehicle Scrapping

Proposed Amended Rule 1610 is added to the July schedule.

Rule 1624 – Credits for Clean Pleasure Craft Engines (CM# MOF-07)

Proposed Rule 1624 is rescheduled from July 1998 to July 1999. Staff is still awaiting input from industry on the operability verification and other provisions of the rule. In addition, U.S. EPA has promulgated a nationwide regulation on pleasure craft, while ARB is in the verge of promulgating more stringent statewide standards (late 1998). These regulations may significantly impact the credit generation mechanism, cost-effectiveness and overall viability of proposed Rule 1624. Therefore, staff is recommending postponement and reassessment of the proposed rule until after the state regulation is promulgated.

Rule 219 – Equipment Not Requiring a Written Permit Pursuant to Regulation II
Rule 222 – Filing Requirements for Non-Permitted Equipment
Rule 401 – Visible Emissions

The permit streamlining effort that will be implemented through Rules 219, 222, and 401 is being moved from August 1998 to September 1998 in order to provide better coordination with other streamlining efforts and CEQA analysis. The Permit Streamlining Task Force will consider this project as part of their review of ongoing efforts. At the public workshops for these rules on May 28, 1998, staff is expecting input on other equipment that may be suitable for this non-permit approach. These ideas need to be analyzed in the CEQA document, which will be released in approximately mid-June.

Rule 1469 – Hexavalent Chromium Emissions from Chrome Plating and Chromic Acid Anodizing Operations
Rule 1169 – Hexavalent Chromium-Chrome Plating and Chromic Acid Anodizing

Public hearing for adoption of Proposed Rule 1469 and rescission of existing Rule 1169 is rescheduled from August 1998 to October 1998 due to ARB’s delay in adoption of new amendments to the Airborne Toxic Control Measure.

As part of the Chairman’s Environmental Justice Initiatives, expanding the list of compounds included in Rule 1401 will be evaluated. Addition of non-cancer impacts will also be addressed. Definition of Minor Violation and Guidelines for Issuance of Notice to Comply
Effective January 1, 1996, AB 2937 (Brulte) required each air district in the state of California to develop a rule governing issuance of a Notice to Comply for minor violations. A CAPCOA task force was convened that year to draft core rule language for adoption by all districts statewide, subject to minor local modifications as required. Following numerous public consultation meetings held throughout the state in 1997, comments were evaluated and rule language modified as necessary. Proposed Rule 112 - Definition of Minor Violation and Guidelines for Issuance of Notice to Comply represents the culmination of this effort to meet the requirements of AB 2937.

Equipment Not Requiring a Written Permit Pursuant to Regulation II
Proposed amendments delete written permit requirements for equipment found to emit negligible amounts of air contaminants or equipment regulated by federal or state air emission standards. Amendments may also add written permit requirements for equipment found to emit significant amounts of air contaminants.
Filing Requirements for Non-Permitted Equipment
Proposed rule will require some equipment that is currently exempt or proposed for exemption from permit under Rule 219 to register certain information with the AQMD to help facilitate compliance and outreach efforts. An annual update and compliance certification is being proposed. Charbroilers and other equipment are being considered for this program.
Visible Emissions
An exemption is being considered for charbroilers. This equipment would still be subject to the states’ opacity limits.
