Stationary Source Committee

SYNOPSIS:

The Stationary Source Committee met Friday, October 23, 1998. Following is a summary of that meeting. The next meeting will be November 20, 1998, at 11:00 a.m., in Conference Room CC8.

Attendance

The meeting began at 11:05 a.m. Present were Committee Members Jon Mikels, acting for Committee Chair Mee Hae Lee and Leonard Paulitz. Absent were Committee Members Richard Alarcòn, Ron Loveridge, and James Silva. Because there were only two Committee Members present, they acted as a reviewing body rather than a recommending body.

DISCUSSION ITEMS

  1. Update on Home Rule Advisory Group:

    Jack Broadbent, Assistant Deputy Executive Officer explained that this is a status report at the request of Councilmember Soto for the consent calendar. A brief review of recent activities was provided to the Committee and there were no comments received.

  2. Update on Environmental Justice Initiative #9 – Portable Engines:

    Jack Broadbent recommended this item be continued to the next meeting. Staff feels that the committee would benefit from their further discussion with the construction industry. Jon Mikels agreed.

  4. Rule 1158 Update:

    It was agreed that this item be continued to the next meeting. The public hearing on Rule 1158 is currently scheduled for February, 1999.

  5. Issue an RFP to Provide Temporary Engineering Services:

    Carol Coy reported that this is a recommendation to continue the current program. We have had two contractors on board since the spring of 1997. The current contract expires December 31st of this year. Through these two contractors there have been 763 applications processed at a total cost of about $ 355,000. The average cost has been about $ 466 per application. After a significant training phase, this program has worked very well, and staff is recommending that at Board discretion and Executive Officer recommendation during subsequent budget discussions, we continue funding this activity for the next three years. There was no objection. This RFP is in the purview of the Stationary Source Committee.

  6. Notice of Violation Penalty Summary:

    Peter Mieras stated that this report is for the information of the Committee.

  7. Rule Forecast Report:
    There may be two items with significant testimony at the November Board meeting. Carol Coy said that most issues with Rule 112 have been resolved but several individuals may continue to request that public nuisances due to odors be treated as a minor violation. In keeping with CAPCOA and ARB guidelines, staff believes that since state law already established that a "considerable" number of persons be impacted to constitute a public nuisance, these violations cannot be treated as minor. The second item is that there may be concerns, especially from landfill and refinery representatives that the definitions of chronic and recalcitrant violator were hinged on a very few number of notices to comply and notices of violation. Staff has added language to the current proposal to say that in the cases of complex operations there will be a larger number defined within the actual District implementation protocol.

    Jack Broadbent said that we also have Rule 1610 in November. In December there are two rules, Rule 1151 and Rule 1186. Rule 1151 is the auto refinishing rule. There is a concern that with the product variance expiring in December, that the auto refinishing industry cannot comply with the limits that will be imposed once that variance expires. Rule 1186 will also be considered in December. This rule deals with PM emissions from paved and unpaved roads.

    Relative to Rule 1610, Supervisor Mikels asked for a clarification on the number of cars scrapped annually. Staff confirmed it is approximately 2,000 cars a year being scrapped under Rule 1610. This equates to about 20,000 cars in the past six years. Supervisor Mikels expressed concern that one of the items for funding on MSRC was a half million dollars for car scrapping at ARB. He felt 300 cars for $500,000 didn’t make sense when our scrapage cost that we experience here is approximately $750.00 per car.
