This report highlights AQMD rulemaking activity for 1998. Upcoming public workshops are noted, both in the regular calendar and in a separate list at the end of the report.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Rulemaking is a dynamic process, subject to ongoing revision. Scheduling changes which occurred since last month’s forecast are summarized:

Rules to be Rescheduled/Removed and Additions

CTS-03 – Consumer Product Education and Labeling Program
Proposed Control Measure #97CTS-03 is rescheduled from November 1998 to December 1998. Additional time is needed for staff to seek additional public input and finalize public outreach materials.

MSC-02 – In-Use Compliance Program for Air Pollution Control Equipment

(all pollutants)

Proposed Control Measure #97MSC-02 is rescheduled from December 1998 to April 1999. Additional time is required to assess technology in conjunction with vendors and users of air pollution control equipment.

WST-02 – Emission Reductions from Composting Operations

Proposed Control Measure #97WST-02 is rescheduled from December 1998 to September 1999. Additional time is needed for further analysis of data and to enable staff to research additional requirements needed in the development of the control measure.
Rule 218 – Continuous Emissions Monitoring

Rule 218.1 – Continuous Emission Monitoring Performance Specifications

Proposed Amended Rules 218 and 218.1 are rescheduled from November 1998 to January 1999. Additional time is needed to allow staff to consult with U.S. EPA and CARB regarding impacts of proposed stringency on Title V permits.

Rule 461 – Gasoline Transfer and Dispensing

Proposed Amended Rule 461 is rescheduled from December 1998 to January 1999. Amendments are to include findings of vapor recovery compliance plan. An additional month is needed to ensure consistency with CARB guidance, and for additional public outreach.

Rule 1128 – Paper, Fabric, and Film Coating Operations
Proposed Amended Rule 1128 is rescheduled from November 1998 to March 1999. Staff is reviewing available data to determine if further emission reductions are available from industry at this time.
Rule 1130 – Graphic Arts

Proposed Amended Rule 1130 is rescheduled from December 1998 to February 1999. Rule development work is pending while staff waits for necessary information from the Printing Industries Association.

Rule 1166 – Volatile Organic Compound Emissions from Decontamination of Soil

The rule amendment was intended exclusively for improved enforceability. Staff will investigate changes to operating policies and procedures through permit conditions in lieu of a rule change. Staff is recommending this item be taken off calendar.

Rule 1405 – Control of Ethylene Oxide & CFC Emissions from Sterilization or Fumigation Processes
Proposed Amended Rule 1405 is rescheduled from December 1998 to June 1999. Although CARB "passed" the ETO ATCM, they delegated certain changes to their Executive Officer. These changes are in draft and under legal review at CARB. Although staff do not believe there will be substantial changes to this draft by CARB’s legal staff, it is critical that all language carried over from the ATCM be identical where applicable.
Rule 1407 – Control of Emissions of Arsenic, Cadmium, and Nickel from Non-Ferrous Metal Melting Operations

Rule 1420 – Emissions Standards for Lead

CARB rescheduled their Board hearing on amending the state ATCM for controlling emissions from non-ferrous metal melting operations to February/March 1999. Since the purpose of the proposed amendments to Rules 1407 and 1420 is to incorporate changes to the ATCM, staff is recommending rescheduling these rules from December 1998 to June 1999.

Effective January 1, 1996, AB 2937 (Brulte) required each air district in the state of California to develop a rule governing issuance of a Notice to Comply for minor violations. A CAPCOA task force was convened that year to draft core rule language for adoption by all districts statewide, subject to minor local modifications as required. Following numerous public consultation meetings held throughout the state in 1997, comments were evaluated and rule language modified as necessary. Proposed Rule 112 - Definition of Minor Violation and Guidelines for Issuance of Notice to Comply represents the culmination of this effort to meet the requirements of AB 2937.

1610 Old-Vehicle Scrapping

The Governing Board directed staff to bring back amendments that address EPA comments regarding the destruction of emissions related to engine components and respond to concerns raised by the public relative to the impact of the program on collectible cars and availability and cost of old vehicle parts.

The proposed rule will be implemented in two steps. Step one will consist of refining the emissions inventory and assessing control methods for organic waste disposal facilities. Step two will include implementation of cost-effective and technically feasible control methods.

The proposed amendments simplify and streamline the soil erosion control submittal and review process applicable to agricultural operations by eliminating the plan submittal requirement and allowing agricultural operations to maintain their exemption from the rule provided they voluntarily implement certain soil erosion control practices. The amendment postpones the effective date of the provision by six months to allow for public outreach. Certain EPA approvability issues are also addressed.

1186 PM10 Emissions from Paved and Unpaved Roads, and Livestock Operations

The proposed amendment postpones the effective date for the procurement of PM10 efficient sweepers to allow for the completion of specific technical sweeper testing protocols, subsequent testing of the sweepers and adequate time for budgeting by the cities.

At the July 10, 1998 Governing Board meeting, the Board continued the hearing for six months for consideration of adding additional nickel compounds, sodium hydroxide and hydrochloric acid. The Board will also consider carcinogens that have had risk values finalized by OEHHA. A report will also be made on changes to risk values for compounds already in the rule.

To address these concerns, staff is reviewing the level of control that the rule requires as well as monitoring and recordkeeping requirements. In addition, staff is reviewing the Executive Officer discretion language and test methodology for measuring vapor pressure.

Control of Toxic Air Contaminants from Existing Sources

Rule 1402 requires facilities with significant risks for cancer and non-cancer acute and chronic hazards to file and follow risk reduction plans which will reduce risks below specified levels within five years.

As part of the Chairman’s Environmental Justice Initiatives, the list of compounds and the toxics significance thresholds in Rule 1402 will be evaluated, as well as other approaches to reduce toxic risk.

Both Rules 1401 and 1402 will be evaluated for possible amendments to address cumulative impacts from air toxics.

This rule will: evaluate current and expected future emission control technologies for stationary internal combustion engines and amend existing and future emission limits, as appropriate; evaluate continuous emission monitoring and source testing requirements to determine if acceptable alternatives exist and make changes to the monitoring and testing requirements, frequency and methods; evaluate impact of the new PM 2.5 NAAQS and amend rule requirements as necessary.

Reg. XXX* Title V Operating Permits

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. In the last half of 1999, U.S. EPA expects to adopt revisions to regulations that define the minimum elements of an approvable operating permit program. Once EPA’s revisions are adopted, Regulation XXX will be amended to parallel changes in the EPA program.
