This report highlights AQMD rulemaking activity for 1998. Upcoming public workshops are noted, both in the regular calendar and in a separate list at the end of the report.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Rulemaking is a dynamic process, subject to ongoing revision. Scheduling changes which occurred since last month’s forecast are summarized:

Rules to be Rescheduled/Removed and Additions
Rule 201 – Permit to Construct
Proposed Amended Rule 201 is being removed from the November calendar. EPA is finalizing revisions to their New Source Review Reform Guidance Document following an extended period of public comment. Language in the final document will clarify and possibly change current EPA policy regarding allowable pre-construction activities. EPA has advised staff that the final guidance document may be published as early as Spring 1999. Following staff review and public input and guidance, a proposed amended Rule 201 will brought to the Board for consideration and adoption.
Rule 403 – Fugitive Dust
Proposed Amended Rule 403 is added to the December 1998 calendar. The proposed amendments simplify and streamline the soil erosion control submittal and review process applicable to agricultural operations by eliminating the plan submittal requirement and allowing agricultural operations to maintain their exemption from the rule provided they voluntarily implement certain soil erosion control practices. The amendment postpones the effective date of the provision by six months to allow for public outreach. Certain EPA approvability issues are also addressed.
Rule 461 – Gasoline Transfer and Dispensing
CARB’s recent legal opinion makes amendment unnecessary. Proposed Amended Rule 461 is being removed from the October 1998 calendar.
Rule 462 – Organic Liquid Loading
Proposed Amended Rule 462 is rescheduled from December 1998 to May 1999. Additional time is needed for staff to address the NESHAPS equivalency issues and to clarify the previous limited SIP approval by U.S. EPA to be able to proceed with the rule amendment.
Rule 465 – Vacuum Producing Devices or Systems
Proposed Amended Rule 465 is being added to the August 1999 calendar. The amendments are proposed to incorporate SIP changes requested by U.S. EPA which address updating of the definition of volatile organic compounds and the need to explicitly state recording, reporting and record retention requirements in the rule.
Rule 518.2 – Federal Alternative Operating Conditions
Proposed Amended Rule 518.2 is rescheduled from December 1998 to February 1999. Additional time is needed for U.S. EPA to complete the SIP action on the January 12, 1996 version of this rule.

Rule 1102 - Petroleum Solvent Dry Cleaners

CARB has evaluated Rule 1102 – Petroleum Solvent Dry Cleaners and identified certain areas where further emission reductions may be available. Staff has evaluated these areas, and a technical assessment is attached. The rule changes suggested by CARB will not result in significant emission reductions at this time because of the low total emissions from this equipment, so it is recommended that Rule 1102 not be amended. Should the AQMD start to receive permit applications for petroleum solvent dry cleaning equipment, CARB’s concerns will be addressed through amendments to Rule 1102 and through permitting conditions.
Rule 1104 – Wood Flat Stock Coating Operations
Proposed Amended Rule 1104 is rescheduled from November 1998 to April 1999. Additional time is needed for further analysis of data and to enable staff to research additional requirements needed in the amendment of the rule.
Rule 1105.1 – Control of PM10 from FCCUs
Proposed Rule 1105.1 is rescheduled from November 1998 to June 1999. Additional time is needed for staff to fully investigate existing and emerging technologies for the control of PM10 and PM10 precursors.
Rule 1106.1 – Pleasure Craft Coating Operations
Proposed Amended Rule 1106.1 is rescheduled from December 1998 to April 1999. Additional time is needed for further analysis of data and to enable staff to research additional requirements needed in the amendment of the rule.
Rule 1110.2 –Emissions from Gaseous-and Liquid-Fueled Internal Combustion Engines
Proposed Amended Rule 1110.2 is rescheduled from December 1998 to October 1999. Further evaluation is required to establish alternative test methods and CEMS requirements acceptable to CARB and U.S.EPA. Staff is assessing the technical feasibility of the emission standards for landfill and digester gas-fired engines subject to Rule 1110.1. The standards must be met by 2004. After development of the PM2.5 Plan, require additional controls for particulate, if necessary. Establish additional controls for diesel engines, if necessary, based upon the finding of toxicity of diesel exhaust by CARB.
Rule 1140 – Abrasive Blasting
Rule 1403 – Asbestos Emissions from demolition/Renovation Activities
Rule 1423 – Lead Abatement
The CARB is in the process of finalizing a Draft Interim Regulatory Needs Assessment Report on Lead during September or October 1998. A final report will be released January or February 1999. Staff is recommending to reschedule the public hearing of Proposed Amended Rule 1423 from November 1998 to March 1999 to fully utilize CARB’s lead report.

Since Proposed Amended Rule 1140 – Abrasive Blasting and Proposed Amended Rule 1403 – Asbestos Emissions from Demolition/Renovation Activities are part of the of lead-related rule amendments, these rules should also be rescheduled to March 1999.

Rule 1142 – Marine Tank Vessel Operations
Proposed Amended Rule 1142 is rescheduled from December 1998 to March 1999. Additional time is needed for staff to address NESHAPS and enforceability issues.
Rule 1146 – Emissions of Oxides of Nitrogen from Industrial, Institutional, and Commercial Boilers, Steam Generators, and Process Heaters
CARB has evaluated Rule 1146 – Emissions of Oxides of Nitrogen from Industrial, Institutional, and Commercial Boilers, Steam Generators, and Process Heaters and identified certain areas where further emission reductions may be available. The proposed requirements would result in insignificant emission reductions and are not consistent with requirements for similar equipment that are in the AQMD’s RECLAIM program. In addition, the measure is not cost-effective compared to other rules adopted to reduce nitrogen oxide emissions. These issues are discussed in the attached technical assessment. It is recommended, therefore, that Rule 1146 not be amended at this time and these issues be revisited in the 2000 AQMP.
Rule 1158 – Storage, Handling, and Transport of Petroleum Coke
Due to the issues raised by the public relative to Rule 1158, further review of the draft staff report and rule amendment is necessary. Staff is recommending that Proposed Amended Rule 1158 be rescheduled from November 1998 to December 1998.
Rule 1173 – Fugitive Emissions of Volatile Organic Compounds
Proposed Rule 1173 is rescheduled from December 1998 to April 1999. Additional time is needed for staff to further analyze the new data and reports provided by the regulated community and to address NESHAPS issues.
Rule 1186 – PM10 Emissions from Paved and Unpaved Roads, and Livestock Operations
Proposed Amended Rule 1186 is added to the December 1998 calendar. The proposed amendment postpones the effective date for the procurement of PM10 efficient sweepers to allow for the completion of specific technical sweeper testing protocols, subsequent testing of the sweepers and adequate time for budgeting by the cities.
Rule 1437 – Furniture Stripping Operations
The Board recently committed staff to conduct a technology assessment of wood product stripping permit units to address the 18-month exemption stated in Rule 1401 (7/10/98). Therefore, the public hearing for Proposed Rule 1437 should be rescheduled from December 1998 to September 1999 to allow the technology to develop and staff to evaluate the results through a technology assessment.
Regulation XVI – Mobile Source Credit Programs
Regulation XVI is rescheduled from December 1998 to June 1999. Amendments to rules will be required if Rule 2500 - Intercredit Trading is approved.
Rule 1610 – Old Vehicle Scrapping
Proposed Amended Rule 1610 is being added to the October 1998 calendar. The Governing Board directed staff to bring back amendments that address EPA comments regarding the destruction of emissions related to engine components and respond to concerns raised by the public relative to the impact of the program on collectible cars and availability and cost of old vehicle parts.

Proposed Amended Rule 1610 is also added to the March 1999 calendar. ARB’s statewide rule on car scrapping, anticipated to be completed by the end of 1998 and recommendations from the Rule 1610 Working Group, may necessitate further rule amendments.

Regulation XX – RECLAIM
Proposed amendments to Regulation XX are rescheduled from November 1998 to April 1999. Additional time is needed for staff to further evaluate issues associated with trading zone restrictions, as well as the applicability and definition of "emission increases" in Rule 2005.
Regulation XXX – Title V Operating Permits
Proposed amendments to Regulation XXX rescheduled from December 1998 to December 1999. This proposed revision is in anticipation of U.S EPA’s revision of the Federal Title V program, 40 CFR 70, which has been delayed.

Effective January 1, 1996, AB 2937 (Brulte) required each air district in the state of California to develop a rule governing issuance of a Notice to Comply for minor violations. A CAPCOA task force was convened that year to draft core rule language for adoption by all districts statewide, subject to minor local modifications as required. Following numerous public consultation meetings held throughout the state in 1997, comments were evaluated and rule language modified as necessary. Proposed Rule 112 - Definition of Minor Violation and Guidelines for Issuance of Notice to Comply represents the culmination of this effort to meet the requirements of AB 2937.

Rule 1402 requires facilities with significant risks for cancer and non-cancer acute and chronic hazards to file and follow risk reduction plans which will reduce risks below specified levels within 5 years.

As part of the Chairman’s Environmental Justice Initiatives, the list of compounds and the toxics significance thresholds in Rule 1402 will be evaluated, as well as other approaches to reduce toxic risk.

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. On August 29, 1994, U.S. EPA proposed revisions to regulations that define the minimum elements of an approvable operating permit program. These regulations may be finalized in 1998; if so, then Regulation XXX would be amended to parallel changes in the EPA program.
