The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes which occurred since last month’s forecast are summarized. The revised schedule reflects the staff’s recent court filing for the lawsuit brought by environmental groups relative to the 1994 Air Quality Management Plan. The rulemaking schedule contained herein is subject to change based on the outcome of the litigation. Some measures may need to be delayed to allow room to incorporate additional measures that may be ordered to be implemented by the court in the SIP litigation case.

Rules to be Rescheduled/Removed and Additions

Rule 1110.2 – Emissions from Gaseous- and Liquid-Fueled Internal Combustion

Engines

Staff is working with EPA on several issues identified recently by EPA that will affect approval of the rule into the State Implementation Plan. Staff recommends deferring rule amendments until February 2000 to coordinate SIP changes with other rule amendments. No emission reductions are anticipated from the proposed amendments.
Rule 1402 – Control of Toxic Air Contaminants from New and Existing Sources
Staff will report to the Board at its September 1999 meeting on progress toward Environmental Justice Initiative #10, including seeking Board approval to develop comprehensive air toxics reduction strategies to address cumulative toxic exposures in the Basin. Staff is proposing to divide potential amendments to this rule into two phases. The first phase will focus on the enhancements to improve the effectiveness of the rule. This amendment is scheduled for December 1999. The second phase of amendments will consider potential changes in thresholds and other substantive changes to the rule such as means to convert diesel fleet vehicles to clean fuel. These potential amendments will be incorporated into the comprehensive toxic reduction plan and a schedule for amendments to be determined therein.
Rule 1405 – Control of Ethylene Oxide & CFC Emissions from Sterilization or Fumigation Processes
Proposed Amended Rule 1405 is rescheduled to a future date to be determined following the approval of the state ATCM which may occur on November 1999.
Rule 1421 – Control of Perchloroethylene Emissions from Dry Cleaning Systems
The contract underway to study emission leaks from dry cleaners is currently scheduled for completion by the end of the calendar year. Results of this study are expected to be the basis for rule amendments. Staff recommends moving this project to March 2000.
Reg. XXV – Intercredit Trading (CM#97FLX-01)
Staff recommends to delay to year 2000 this rulemaking until EPA finalizes the Economic Incentive Program (EIP) Guidance.

Proposed revisions may provide additional flexibility to new sources in the AQMD, consistent with anticipated changes in the federal NSR regulations and NSR policies, due to be finalized in 1999. The proposal may also address the issue of potential future shortfalls in NOx emission credits with respect to the state law requirement of "no net emission increase" from new permitted sources within the AQMD.

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. In the last half of 1999, U.S. EPA expects to adopt revisions to regulations that define the minimum elements of an approvable operating permit program. Once EPA’s revisions are adopted, Regulation XXX will be amended to parallel changes in the EPA program.
