SYNOPSIS:

This report highlights AQMD rulemaking activity for 1999. Upcoming public workshops are noted, both in the regular calendar and in a separate list at the end of the report.

Background

AQMD is required by state law to publish a list of all rules potentially scheduled for consideration during the coming year. Every January, the Rule and Control Measure Forecast Report is expanded for this purpose and to present a progress report for the Board. The rule schedule for 1999 is demanding. In order for the region to maintain emission reduction progress toward attainment and implement the AQMP, and establish EPA mandated programs, staff will be bringing approximately 13 control measures contained in the 1997 AQMP and approximately 46 rules for proposed amendment/adoption before the Board for action in 1999.

Proposal

Several significant hearing items are scheduled to be brought before the Board in 1999. Among the most critical are the following:

New Source Review of Carcinogenic Air Contaminants and Control of Toxic Air Contaminants from New and Existing Sources

Rule 1402 requires facilities with significant risks for cancer and non-cancer acute and chronic hazards to file and follow risk reduction plans which will reduce risks below specified levels within five years. As part of the Chairman’s Environmental Justice Initiatives, the list of compounds and the toxics significance thresholds in Rule 1402 will be evaluated, as well as other approaches to reduce toxic risk. Both Rules 1401 and 1402 will be evaluated for possible amendments to address cumulative impacts from air toxics.

Architectural Coatings

Staff is evaluating available and future coating technologies to determine what existing VOC limits can be amended to obtain additional emission reductions from architectural coatings.

Intercredit Trading (CM# FLX-01)

AQMD is developing market incentive rules under the intercredit trading markets to broaden credit generation and use, and to maximize trading opportunities between stationary and mobile sources. The program objectives minimize compliance costs, and promote advancement and commercialization of air pollution control technologies.

Fugitive Emissions of Volatile Organic Compounds (CM #97FUG-04)

Proposed amendments will consider lowering leak thresholds for minor and major gas leaks; require the use of trained individuals for leak inspections; consider the new federal NESHAPs requirements; and address other issues regarding implementation of inspection and maintenance.

Fluid Catalytic Cracking Units (CM #97CMB-09)

Proposed rule will reduce PM10 emissions from petroleum refinery fluid catalytic cracking units.

Furniture Stripping Operations

Proposed rule will control methylene chloride emissions from furniture stripping operations.

Storage, Handling, and Transport of Coke, Coal and Sulfur

Proposed amendments will expand the scope of the rule to include coal and sulfur, require all coke storage to be enclosed, and establish additional standard for storage, handling, and transport.

Furthermore, Control Measure #97MSC-01 – Promotion of Lighter Color Roofing and Road Materials and Tree Planting Programs (All Pollutants) is to be implemented in 1999 through local government model ordinances, legislative strategies for incentives, and public outreach rather than AQMD rulemaking. Technical studies conducted by the AQMD have not resulted in the development of a methodology to quantify emission reductions that meet U.S. EPA quantification requirements. However, the U.S. EPA through the Cool Communities Program has begun to partner with several U.S. cities to demonstrate the benefits of this control measure. The AQMD is working with the City of Los Angeles (one of U.S. EPA’s program partners) and the U.S. EPA on developing quantification protocols to quantify the benefits of this measure.

In addition, Proposed Amended Rule 1403 – Asbestos Emissions from Demolition/Renovation Activities is deleted from the March 1999 Calendar. The proposed amendments were solely administrative with no emission reductions. Staff assessment has concluded that the elements of the proposal can be better handled through AQMD rule implementation guidelines and procedures and therefore, a rule amendment is not required. A Technical Assessment Study is attached following the Rule and Control Measure Forecast for reference.

Implementation Plan

Staff is committed to maintaining the proposed hearing dates established in the Rule and Control Measure Forecast Report to achieve the necessary emission reductions required by the AQMP.
