This report highlights AQMD rulemaking activity for 1999. Upcoming public workshops are noted at the end of the report.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes which occurred since last month’s forecast are summarized. The revised schedule reflects the staff’s recent court filing for the lawsuit brought by environmental groups relative to the 1994 Air Quality Management Plan. The rulemaking schedule contained herein is subject to change based on the outcome of the litigation. Some measures may need to be delayed to allow room to incorporate additional measures that may be ordered to be implemented by the court in the SIP litigation case.

Rules to be Rescheduled/Removed and Additions

Rule 113 – Credible Evidence
EPA has recently indicated that no rule is necessary to implement the requirements for credible evidence for all California areas. A formal letter will be forthcoming from EPA to CARB on this issue, and the procedures necessary to satisfy EPA. Proposed Rule 113 is removed from the calendar.
Rule 461 – Gasoline Transfer and Dispensing
Additional time is needed to allow testing conducted by ARB to be completed and presented to the public, meet with the impacted parties, and develop a proposal that will improve compliance. Therefore, the proposed amendment is scheduled for November 1999.
Rule 1105.1 – Fluid Catalytic Cracking Units (CM #97CMB-09)
Proposed Amended Rule 1105.1 is rescheduled from September 1999 to December 1999. Additional time is necessary to review emissions data to estimate PM10 emissions inventory, potential reductions, and other implementation issues. Staff has also contacted affected industry representatives and control equipment vendors and is awaiting information that is crucial to rule development.
Rule 1146.2 – Emissions of Oxides of Nitrogen from Large Water heaters and Small Boilers
Staff does not recommend that Rule 1146.2 be amended. Staff will coordinate to assess the rule’s impact on Type II units. Rule 1146.2 is therefore removed from the calendar at this time.
Rule 1171 – Further Emission Reductions from Solvent Cleaning Operations (CM #97 ADV-CLNG 1997 AQMP)
Proposed Amended Rule 1171 is rescheduled from September 1999 to October 1999. Additional time is needed for staff to assess and provide for public participation.
Rule 1186 – PM10 Emissions from Paved and Unpaved Roads, and Livestock Operations
Proposed Amended Rule 1186 is rescheduled from August 1999 to September 1999. Additional time is needed to analyze data from Phase 2 street sweeper evaluations and to develop certification limits for both collection efficiency and normalized mass of entrained PM10 emissions during certification tests.
Rule 1402 – Control of Toxic Air Contaminants from New and Existing Sources
Staff will report to the Board at its August 1999 meeting on progress toward Environmental Justice Initiative #10, including seeking Board approval of comprehensive air toxics reduction strategies to address cumulative toxic exposures in the Basin. Potential amendments to this rule are still to be determined.
Rule 1610 – Old-Vehicle Scrapping
The goal of the next Rule 1610 amendment is to comply with the statewide vehicle scrapping regulation, which is planned to be finalized by ARB in December 1999. To allow for the state’s regulation and for public input as part of this next Rule 1610 rulemaking effort, staff recommends rescheduling Rule 1610 amendments to March 2000.

Equipment Not Requiring a Written Permit Pursuant to Regulation II

Rule 1401 requires staff to return to the Governing Board within 150 days after the Scientific Review Panel finalizes risk values. Acute risk values for about 50 compounds were finalized in February, so the rule is proposed to be updated. An administrative change is also being proposed to the applicability section of Rule 219 to clarify implementation at the request of the Permit Streamlining Task Force.

Once EPA’s revisions are adopted, Regulation XXX will be amended to parallel changes in the EPA program.
