PROPOSAL:

Approve Selection of Consultant for Technical Assistance to Heavy-Duty Fleets as part of MSRC’s Fiscal Year 1999-2000 AB 2766 Discretionary Fund Work Program

SYNOPSIS:

As part of the FY 1999-2000 AB 2766 Discretionary Fund Work Program, the MSRC allocated $200,000 to obtain a consultant team that will provide technical assistance to fleets and operators participating in its On-Road & Off Road Heavy-Duty Vehicle Diesel Pollution Reduction Program. On May 27, 1999, the MSRC considered the TAC’s recommendation and approved the twenty-four month appointment of a consultant team. This contract recommendation is being brought forward prior to other Work Program recommendations so that the consultant team can be under contract to meet the timeline needs of the MSRC’s 1999-2000 Heavy-Duty Work Program. The MSRC is requesting the Board’s approval to contract with this consultant as part of the FY 1999-2000 AB 2766 Discretionary Fund Work Program.

RECOMMENDED ACTION:

  1. Award Task- Order Contract to ARCADIS Geraghty and Miller, Inc. for Technical Assistance to Fleets as part of the FY 99-00 AB 2766 Discretionary Fund Work Program. Subcontractors include Gladstein & Associates, USA Pro, The Planning Center, Charles Powars, and Robert Penny Enterprises.
  1. Authorize the Chairman to execute a 24-month contract with ARCADIS, Geraghty and Miller, Inc. in an amount not to exceed $200,000, with individual task orders to be authorized by the District’s Contracts Manager.

Background

In September 1990 Assembly Bill 2766 was signed into law (Health & Safety code Sections 44220-44247) authorizing the imposition of an annual $4 motor vehicle registration fee to fund the implementation of programs exclusively to reduce air pollution from motor vehicles. AB 2766 provides that 30 percent of the annual $4 vehicle registration fee subvened to the AQMD be placed into an account to be allocated pursuant to a work program developed and adopted by the MSRC and approved by the AQMD Governing Board.

As part of its FY 1999-2000 AB 2766 Discretionary Fund Work Program, the MSRC developed a threefold Heavy-Duty Vehicle Diesel Pollution Reduction Program. The three elements of the Heavy-Duty Program include solicitations for a $6,000,000 Alternative Fuel Transit Bus Program, a $3,400,000 On-Road/Off-Road Program, and a consultant team to provide Technical Assistance to Fleets. Funding for the Technical Assistance to Fleets has a not-to-exceed limit of $200,000. On March 12, 1999, the Board approved the release of all three RFPs. Proposals in response to the Technical Assistance for Fleets RFP 9899-26 were due by 5 p.m. on April 13, 1999.

The objectives of the Technical Assistance to Fleets Program are to:

The successful technical assistance consultant team will be under contract to the MSRC for a 24-month period and will be assigned work on a task-order basis.

Outreach

A brochure, announcing the three Heavy-Duty RFPs, including the Technical Assistance RFP, was mailed to more than 2000 interested parties on the MSRC’s mailing list, all transit agencies in the South Coast AQMD, and to entities on the AQMD’s mailing list of certified minority vendors. In accordance with the AQMD’s Procurement Policy and Procedures, a public notice advertising these RFPs was published in AQMD designated publications. Additionally, the RFPs were placed on the AQMD’s Internet Web site and RFP descriptions were added to the MSRC’s 24-hour hotline. Fifty-three Technical Assistance RFPs were mailed to interested parties. A Bidders’ Conference/Workshop for the Technical Assistance RFP was held at the AQMD on March 26, 1999 for the benefit of potential applicants.

Bid Evaluation

Six proposals were received by the April 13, 1999, deadline. The MSRC’s Heavy-Duty Subcommittee, consisting of six MSRC-TAC members, performed the evaluation of the six proposals. Proposals were evaluated and scored based upon the evaluation criteria stated in the Request for Proposal. Based upon this evaluation, the consultant team headed by ARCADIS Geraghty and Miller, Inc. was selected by the Subcommittee for recommendation to the MSRC, with the condition that staff negotiate labor rates with the potential contractor prior to finalizing the contract. Although the Subcommittee deemed the ARCADIS proposal superior from a technical standpoint, the proposed rates, especially those associated with subcontractor overhead, were significantly higher than the next highest-ranked proposer.

On May 13, 1999, the Subcommittee presented its recommendation to the MSRC-TAC, where it was unanimously approved for recommendation to the MSRC. On May 27, 1999, the MSRC unanimously approved this recommendation and is requesting that the Board award a contract to ARCADIS, Geraghty and Miller, Inc. as part of the FY 1999-00 AB 2766 Discretionary Fund Work Program. (Attachment 1 lists the six proposals and the score and rank for each based upon technical review and evaluation.)

Resources Impacts

The AQMD acts as fiscal administrator to the AB 2766 Discretionary Fund Program (Health & Safety Code Section 44243). Money received for this program is recorded in a special revenue fund (Fund 23), and the contract will be drawn from this fund. This contract will have no fiscal impact on the AQMD’s operational budget.
