The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Rulemaking is a dynamic process, subject to ongoing revision. Scheduling changes which occurred since last month’s forecast are summarized. The rulemaking schedule contained herein is subject to change based on the outcome of the current litigation with environmental groups relative to implementation of the 1994 Air Quality Management Plan. Some measures may need to be delayed to allow room to incorporate additional measures that may be ordered to be implemented by the court in the SIP litigation case.

Rules to be Rescheduled/Removed and Additions

Rule 201 – Permit to Construct
Proposed Amended Rule 201 was scheduled for July 1999 to incorporate the Federal EPA’s interpretation of which preconstruction activities are allowed prior to the issuance of the permit. The EPA’s proposed New Source Review (NSR) Reform contains provisions that may alter the existing interpretation. Rule 201 is rescheduled to a future date to be determined following the EPA’s promulgation of NSR Reform.
Rule 518.2 – Federal Alternative Operating Conditions
Recent regulatory actions by EPA for potential rule approval have not yet been finalized. Staff will reschedule this rule for any amendments that may be found necessary to attain EPA’s approval for a SIP amendment. As such, this schedule is still to be determined.
Rule 1104 – Wood Flat Stock Coating Operations
Proposed Amended Rule 1104 is rescheduled from July 1999 to August 1999. Additional time is necessary to determine compliance impacts of incorporating ARB’s recommendations into the rule.
Rule 1130 – Graphic Arts
Proposed Amended Rule 1130 is rescheduled from July 1999 to October 1999. Additional time is necessary to assess the potential for emission reductions from various ink categories.
Rule 1155 – Disposal of Materials Containing VOC (CM#97WST-04)
Proposed Rule 1155 is rescheduled from July 1999 to October 1999. Additional time is necessary to assess available inventory information, potential for emission reductions and the feasibility of developing a rule.
Rule 1158 – Storage, Handling, and Transport of Coke, Coal and Sulfur
Proposed Amended Rule 1158 is rescheduled to June 1999. Additional time is needed to recirculate the Environmental Analysis on the amendments for public review after two tables were inadvertently omitted.
Rule 1407 – Control of Emissions of Arsenic, Cadmium, and Nickel from Non-Ferrous Metal Melting Operations

Rule 1420 – Emissions Standards for Lead

Proposed amendments were to address changes to the state ATCM. Since the state ATCM has not yet been changed, these rules are being removed from the calendar.
Regulation XVI – Mobile Source Credit Programs
Revisions to Reg. XVI rules may be needed if Rule 2500 – Intercredit Trading Program is approved. The proposed revisions will be developed after Rule 2500 is adopted and hearing date will be set upon approval of Rule 2500.
Rule 1624 – Credits for Clean Pleasure Craft Engines (CM#97MOF-07)
Recent regulatory actions by ARB led to a reevaluation on the necessity of the proposed rule development. Staff is in discussion with ARB and interested parties on the next steps. As a result, the date for this credit program development has not been determined.

1158 Storage, Handling, and Transport of Coke, Coal and Sulfur

The purpose of Rule 1158 is to reduce the potential of a public nuisance or violation of Rule 403 limits caused by emissions of airborne particulate from storage, handling, transport of coke, coal and sulfur.

The proposed rule will set guidelines and requirements for equipment manufacturing and suppliers to guarantee the performance of each air pollution control piece of equipment or system within specified operating parameters for a specific period of operations. Emission reductions are expected through maintenance of uniform performance standards.

The amendments are proposed to incorporate SIP changes requested by U.S. EPA. The proposed amendments include updating of the definition of volatile organic compounds and the need to explicitly state recording, reporting and record retention requirements in the rule.

Control of Toxic Air Contaminants from New and Existing Sources

Rule 1402 requires facilities with significant risks for cancer and non-cancer acute and chronic hazards to file and follow risk reduction plans which will reduce risks below specified levels within five years.

As part of the Chairman’s Environmental Justice Initiatives, the list of compounds and the toxics significance thresholds in Rule 1402 will be evaluated, as well as other approaches to reduce toxic risk.

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. Once EPA’s revisions are adopted, Regulation XXX will be amended to parallel changes in the EPA program.
