The Stationary Source Committee met Friday, March 24, 2000. Following is a summary of that meeting. The next meeting will be April 28, 2000, at 10:30 a.m., in Conference Room CC8.

The meeting began at 10:40 a.m. Present were Jon Mikels, acting Committee Chair, and Committee Members Ron Loveridge and Leonard Paulitz (arrived 11:05). Also present was Board Member Jane Carney. Committee Member Norma Glover was absent.
DISCUSSION ITEMS
Rule 216 - Appeals
Jack Broadbent, Deputy Executive Officer, Planning, Rule Development & Area Sources, gave a brief update on the amendment to Rule 216. Rule 216 sets forth the requirements for appeals of actions by staff relative to permit and plan issuance. This amendment involves changes to Rule 216 to reflect recent changes to the Health and Safety Code which allow for appeals to be filed up to thirty days rather than the current ten days after staff action. This item will be going to the Board for consideration in May.
Rule 219 Equipment Not Requiring a Written Permit Pursuant to Reg. II
Jack Broadbent also gave a brief update on this item. Rule 219 lists a number of equipment and categories which are not required to be permitted. This amendment will clarify a number of the equipment categories.
Rule 222 Filing Requirement for Non-Permitted Equipment Jack Broadbent also presented this item. Staff is proposing to amend Rule 222 to include boilers and process heaters with a rated heat input capacity from 1,000,000 Btu per hour up to 2,000,000 Btu per hour. This amendment would add 12,000 boilers and process heaters to the filing program that had been previously exempt. Staff recommends this equipment require registration to allow staff to inventory its location to ensure compliance with upcoming compliance deadlines which will require retrofit control technology.
Reg. XIII New Source Review
Pom Pom Ganguli, Manager, Planning, Rule Development & Area Sources, presented this amendment to Reg. XIII. This item is being proposed for public hearing in July. The main purpose of this amendment it to bifurcate the current BACT requirement into LAER for federal major sources, and to exempt minor sources from LAER. BACT would be applied under state law and under AQMD rules for minor sources. A new BACT guideline is being created which will reflect all source categories that are commonly permitted. The current guidelines that have over 200 categories, are being consolidated into 130 to 150 source categories. There are no changes to the existing requirements for
LAER.
Preliminary written concurrence from EPA was received by staff in December 1999. Two public workshops have been held. The next workshop is scheduled for April 7, at which the minor source BACT guideline will be released to the public for review. The fourth workshop is scheduled for May and additional workshops will be added if necessary. An Environmental Assessment will be prepared and the Notice of Preparation is soon to be released. A public adoption hearing will be held in July.
Reg. III - Fees
Lee Lockie, Director, Planning, Rule Development & Areas Sources presented this item. The California Health and Safety Code establishes the authority to collect fees to cover the AQMD cost of planning, inspections, permitting and monitoring related activities. Staff is proposing to amend ten fee rules. Proposed fee increases include a 2.9 % increase across-the-board, 11% increase in emissions fees, second phase increase for gasoline nozzles and Title V permits; Hearing Board fee adjustment and a new small fee for employee transportation coordinator training. Those affected would be any stationary or indirect source currently paying fees to the District.
An AQMD budget shortfall due to a continuing decline in annual emissions has necessitated the increase in annual emission fees. This recommendation will affect only the 1700 fee payers whose annual emissions exceed four tons per year. The proposals restructuring of the Hearing Board fee schedule and moderate increase in the Boards fees serve as a cost-recovery measure for a majority of the services provided by the Hearing Board. A public hearing for adoption of this regulation will be held in May.
