The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMDs rulemaking and control measure implementation schedule. Scheduling changes which occurred since last months forecast are summarized. There may have been changes to this report since review by the Stationary Source Committee.
Rules to be Rescheduled/Removed and Added

Rule 1138.1 Control of Emissions from Underfired Charbroiler Restaurant Operations (CM#99 PRC-03, Phase II) |
|
Proposed Rule 1138.1 is being postponed from October to November in order to meet the requirements of the 1999 amendments to the 1997 AQMP. The 1999 amendments require a report to the Board at least three months prior to rule adoption when cost-effectiveness for VOCs exceeds a specific threshold. At the August Board meeting, staff will provide a report summarizing the status of technology development and preliminary cost-effectiveness. Control requirements to reduce PM and VOC emissions from underfired charbroilers will be proposed based on cost-effective control technology. |

Rule 1166 Volatile Organic Compound Emissions from Decontamination of Soil |
|
Proposed amended Rule 1166 is being postponed from October to December to allow additional time to evaluate and analyze the impact of additional requirements to improve enforceability in several areas, i.e., handling, storage, transportation and treatment of contaminated soil. The proposed amendment will further limit the emissions of VOCs during the treatment of contaminated soil. |

Rule 1191.1 Clean On-Road Light- and Medium-Duty Fleet Vehicles for Private Fuel Suppliers and Utilities |
|
Proposed Rule 1191.1 is being added and will be scheduled for a date uncertain. The proposed rule is an expansion of Rule 1191 and would require private fuel suppliers and private utilities to purchase cleaner burning or alternative fueled vehicles. |

Rule 1195 Clean On-Road School Buses |
|
Proposed Rule 1195 is being postponed from August to October to allow additional time to develop data on emissions, cost, feasibility, and to synchronize with TAOs demonstration program. Proposed Rule 1195 will require public school bus fleet operators to purchase or lease low-emission light- and medium-duty vehicles when adding or replacing vehicles in the fleet. |

Rule 1196 Clean On-Road Heavy-Duty Public Fleet Vehicles |
|
Proposed Rule 1196 is being rescheduled from August to September in order to allow more time for staff to review and develop the rule and to seek input from the affected parties. The proposed rule will require public fleet operators to purchase or lease low-emission light- and medium-duty vehicles when adding or replacing vehicles in the fleet. |

Rule 1302 New Source Review Definitions |
|
Proposed amended Rules 1302, 1303, 1306 and 2000 are being postponed from August to September to allow sufficient time for the CEQA process to be completed. The proposed amendments will separate Best Available Control Technology (BACT) into Lowest Achievable Emissions Rate (LAER) for federal major sources and state BACT for minor sources. |

Rule 1610 Old Vehicle Scrapping |
|
Proposed amended Rule 1610 is being postponed from August to September to allow time to evaluate proposed rule changes for auto-scrapping and vehicle repair program. Review and coordination with ARB for changes are necessary in order to be compatible with the statewide rule on car scrapping. [ARB's statewide rule on car scrapping and recommendations from the Rule 1610 Working Group may necessitate further rule amendments or the creation of a vehicle repair program.] |

Rule 1612.1 Credits for Clean Heavy-Duty Vehicles |
|
Proposed Rule 1612.1 is being scheduled for hearing in November. The proposed rule will enable NOx credits from early conversion of diesel engines to clean fuels to provide credits for use by RECLAIM facilities. Several types of categories are being considered. This pilot program is part of AQMD's efforts to advance trading programs. |

The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source specific toxic related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located at the end of the report (Attachment D).
