Rule and Control Measure Forecast

SYNOPSIS: 

This report highlights AQMD rulemaking activity for the year 2000. Upcoming public workshops are also noted in the report.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes which occurred since last month’s forecast are summarized.

Rules to be Rescheduled/Removed and Added

Rule 407

Liquid and Gaseous Air Contaminants

Amendments to Rule 407 are being added to the forecast report and are scheduled for March 2001. The Proposed amendments may adjust the concentration or averaging time for carbon monoxide emissions for gray cement kilns.

Rule 442

Usage of Solvents (CM#99 CTS-020)

The proposed amendment is being rescheduled from November to December in order to develop a more accurate universe and inventory for emission reductions calculations. The proposed amendment will delete obsolete language, reallocate VOC emissions to other rules and establish VOC limits from solvent usages in the remaining provision of the rule.

Rule 1138.1

Control of Emissions from Underfired Charbroiler Restaurant Operations (CM#99 PRC-03, Phase II)

Proposed Rule 1138.1 is being rescheduled from November to March 2001 to allow time for more control options to be developed. Control requirements to reduce PM and VOC emissions from underfired charbroilers will be proposed based on cost-effective control technologies.

Rule 1146

Emissions of Oxides of Nitrogen from Industrial Institutional and Commercial Boilers, Steam Generators, and Process Heaters

Proposed amendments are being rescheduled from October to November to provide additional time for public input. Proposed amendments to Rule 1146 address CARB comments regarding all feasible measures and make the rule comparable to requirements of other air districts.

Rule 1166

Volatile Organic Compound Emissions from Decontamination of Soil

The amendment is being moved from December 2000 to February 2001 to allow additional time to evaluate and analyze the impact of additional requirements to improve enforceability in several areas, i.e., handling, storage, transportation and treatment of contaminated soil. The proposed amendment will further limit the emissions of VOCs during the treatment of contaminated soil.

Rule 1194

Commercial Airport Ground Access

At its August 2000 meeting, the Governing Board continued the consideration of taxicab services under Rule 1194 to its October 2000 meeting. Therefore, staff will be proposing amendments to Rule 1194 relative to taxicab services.

Rule 1195

Clean On-Road School Buses

Proposed Rule 1195 is being rescheduled from October to December to allow more time to develop proposals based on results of current studies. Proposed Rule 1195 will require public school bus fleet operators to purchase or lease cleaner school buses when adding or replacing school buses in the fleet. Under Sections 40919 and 40447.5 of the Health and Safety Code, the AQMD can require fleet operators of 15 or more vehicles to purchase cleaner burning vehicles.

The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source specific toxic related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located at the end of the report (Attachment D).
