The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month's forecast are summarized.
Progress in 2000
Significant progress was made in 2000 in the development and adoption of rules and rule amendments. Twenty-eight rules were amended and nine rules were adopted including seven SIP measures. These rules achieve about 23 tons/day VOC, and minor NOx reductions, when fully implemented, based on the 1997 AQMP baseline emission inventories.
The AQMD adopted six clean vehicle fleet rules in response to a 1999 study (MATES II) that showed that 70% of the 1,400 in a million lifetime cancer risk from breathing toxic air pollution in the region stemmed from diesel particulate emissions. The series of regulations that were adopted include Rule 1191, which will cover light- and medium-duty vehicles, Rule 1192 covering transit buses, and Rule 1193 requiring fleets of public and private waste hauling trucks to use clean fuels or low emissions technology. Rule 1186.1 will require public and private fleet operators to purchase or lease only alternative fuel or otherwise less-polluting street sweepers. Rule 1194 will require taxi, shuttle van, limousine and courtesy shuttle services to purchase clean vehicles when replacing vehicles or forming a new fleet. Rule 1196 will require government fleets with 15 or more heavy-duty vehicles to buy alternative-fueled, gasoline-powered or dual-fuel models. Further, to facilitate reductions in diesel emissions, Rule 431.2 was amended to require lower sulfur content in diesel fuel.
Also during the year, Rules 1401 and 1402 were amended to mitigate the impacts of key toxic air contaminants from both existing and new or modified sources. The Board also adopted a comprehensive Air Toxics Control Plan to further reduce toxic emissions over the next ten years.
Also, a number of rules were amended to improve enforceability, and/or address CARB and EPA concerns.

Rule 1186 |
PM10 Emissions from Paved and Unpaved Roads, and Livestock Operations |

Based on the number and variety of street sweepers that have been Rule 1186-certified since the testing and certification procedures were established, staff is considering amendments to Rule 1186 that would remove the exemption [(i)(3)] for purchasing non-certified sweepers. The hearing date in 2001 for this amendment is to be determined. | |

Rule 1405 |
Control of Ethylene Oxide and Chlorofluorocarbon Emissions from Sterilization or Fumigation Processes |
|
Proposed amendment to Rule 1405 scheduled for February is being removed from the rule calendar. The technical assessment (Attachment E) describes emissions and control levels for facilities using ETO for sterilization. No rule changes are recommended. | |

Rule 1425 |
Motion Picture Film Labs |
|
Proposed Rule 1425 is being rescheduled from February to March to provide additional time for public comment and review. Proposed Rule 1425 will reduce perc emissions from motion picture film lab processes such as film cleaning and printing. This rule is one of the industry-specific rules identified in Rule 1402 and the Air Toxics Control Plan. The proposed rule will also implement NESHAP requirements for halogenated solvent cleaning. | |

Rules 3003 |
Applications |

Proposed amendment to Rules 3003, 3005 and Proposed Rule 3008 are being rescheduled from February 2001 to March 2001 to allow staff additional time to seek public input. Proposed Rule 3008 will establish facility emissions limits for Title V minor sources (facilities which have the potential to emit pollutants equal to or less than the major source thresholds for regulated air pollutants and hazardous air pollutants). The adoption of the rule will reduce the number of facilities required to obtain a Title V Facility Permit and compliance will be determined based on specific reporting and recordkeeping requirements. Proposed amendments to Rule 3003 will extend the deadline for filing Title V Facility Permit Applications. Proposed amendment to Rule 3005 will correct EPA-identified deficiencies to allow program approval. |
