Rule and Control Measure Forecast

SYNOPSIS: 

This report highlights AQMD rulemaking activity for the year 2001. Upcoming public workshops are also noted in the report.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month's forecast are summarized.

Rules to be Rescheduled/Removed and Added
 

Rule 102

Definition of Terms

Proposed amendments to Rule 102 are being reinstated to the Rule and Control Measure Forecast Report and is being scheduled for September 2001. The proposed amendments will make a minor change to the definition of "Clean Air Solvent." The current maximum VOC content requirement of 50 grams per liter is proposed at 25 grams per liter to be effective upon rule adoption. This change is necessary to be consistent with Proposed Amended Rule 1122 - Emission Reduction from Degreasing Operations, scheduled for public hearing in August 2001. No other changes are proposed.

Rule 401

Visible Emissions

Proposed amendment to Rule 401 is being added to November 2001 calendar. Proposed amendment includes an exemption from meeting the AQMD visible emissions standard (which is more stringent than the state standard) for charbroilers until September 2001. Development of cost-effective technology for control of such emissions is still under development. Amendments may be proposed to extend the exemption.

Rule 407

Liquid and Gaseous Air Contaminants

Proposed amendment to Rule 407 is being rescheduled from September 2001 to first quarter of 2002 to allow more time for data collection and analysis and discussions with EPA and other parties.

Rule 518.2

Federal Alternative Operating Conditions

Proposed amendment to Rule 518.2 was previously listed as TBD. Key issues have been resolved with EPA so the rule development can proceed. This rule amendment is being scheduled for December 2001.

Rule 1162

Polyester Resin Operations

Proposed amendment to Rule 1162 is being rescheduled from August 2001 to September 2001. Additional time is needed to develop revised inventories, identify control options and potential impacts.

Rule 1105.1

Fluid Catalytic Cracking Units (CM#97 CMB-09)

Proposed amendment to Rule 1105.1 is being rescheduled from September 2001 to November 2001. Additional time is needed to develop revised inventories, identify control options and potential impacts.

Rule 1137

Emission Reductions from Woodworking Operations (PM10) (CM#97 PRC-01)

Proposed Rule 1137 is being rescheduled from July 2001 to October 2001. Staff needs additional time to complete the technical feasibility and cost-effectiveness analysis.

Rule 1138.1

Control of Emissions from Underfired Charbroiler Restaurant Operations (CM#99 PRC-03, Phase II)

Proposed amendment to Rule1138.1 is being rescheduled from September 2001 to December 2001. Additional time is needed for refinement and testing of control technologies.

Rule 1421

Control of Perchloroethylene Emissions from Dry Cleaning Systems

Proposed amendments to Rule 1421 are being rescheduled from September 2001 to December 2001 to allow more time for rule development and stakeholder input.

Metal Finishing
Secondary Aluminum Production

Proposed Rule 1426 and amendments to Rule 1469 are being rescheduled from November 2001 to February 2002. Additional time is needed for rule development.

Rule 1429

Secondary Aluminum Production

Proposed Rule 1429 is being added to November 2001. This rule will implement a state Air Toxic Control Measure (ATCM) for secondary aluminum smelting operations.

Rule 1610

Old Vehicle Scrapping

CARB is in the process of amending the Voluntary Light-Duty Vehicle Retirement (VAVR) regulations. Proposed amendments to Rule 1610 (originally scheduled for adoption on October 2000) are being delayed until the VAVR regulations are finalized, TBD 1st quarter 2002.

Rule 1634

Pilot Credit Generation Pilot Program for Truck Stop Electrification

Proposed Rule 1634 is being added to October 2001 calendar. This rule is another in a series of pilot program credit rules begun with Rule 1612.1 and will create voluntary opportunities to generate NOx credits for use in RECLAIM.

The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source-specific toxic-related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located at the end of the report (Attachment D).
