 Approval of Minutes

Minutes from the April 26, 2001 meeting were unanimously approved, as submitted. The minutes are attached for your information (Attachment 1).

Election of MSRC Chair and Vice-Chair
The MSRC's Operational Policies and Procedures call for the annual election of the MSRC chair and vice-chair in May. Since the May meeting was canceled, this election was conducted in June. The MSRC unanimously re-elected the current chair and vice-chair for another one-year term. Palm Springs Mayor Will Kleindienst, representing the RCTC, was re-elected chair; Bradbury Council Member Bea LaPisto-Kirtley, representing the LACMTA, was re-elected vice-chair.

Approval of FY 2001-02 AB 2766 Discretionary Fund Work Program Final Elements and Funding Solicitations
The MSRC unanimously approved the final elements and funding solicitations for its FY 2001-02 Work Program, as follows:

Further details are outlined in a separate Board letter requesting approval of the above within the consent calendar of the July 20, 2001 Governing Board agenda.

Contract Award for FY 2001-02 Technical Advisor Services
In February 2001 the MSRC released RFP #P2001-31 soliciting proposals for technical advisor services for FY 2001-02. When the RFP closed, only one proposal had been received, which was from the current contractor, Raymond J. Gorski. A subcommittee was formed to evaluate his proposal and conduct a fiscal comparison for equity purposes since only one proposal was received. At its June 27, 2001 meeting, the MSRC approved a contract award of $135,341, which provided a 6% increase above his existing contract and allowed for three one-year options incorporating annual 4% inflation adjustments. The MSRC also took action to incorporate new language into the contract that would allow the contractor to terminate the agreement following a minimum 60-day notification. Approval of this contract award will be incorporated into the FY 2001-02 Work Program letter, as mentioned above.

Miscellaneous Expenditures for FY 2000-01 First and Second Quarters and Approval of the FY 2001-02 Administrative Budget

In May 2000 the MSRC approved the reimbursement of miscellaneous administrative and mailing costs for FY 2000-01 in an amount not to exceed $34,569. At its June 28 meeting, staff provided a report on actual miscellaneous expenditures for the first and second quarters of FY 2000-01 totaling $20,129.78.

Every May the MSRC considers an Administrative Budget for the next fiscal year, as provided by the law which allows a 5% administrative cap. Because the May meeting was canceled, this action occurred in June. The MSRC unanimously approved the FY 2001-02 Administrative Budget totaling $567,478 (more than $43,000 below the statutory cap). The Administrative Budget includes 25% of the technical advisor's contract or an amount not to exceed $33,836 as well as $35,848 for miscellaneous expenditures.

FY 1999-00 Report to ARB on AB 2766 Discretionary Fund Program
On an annual basis the MSRC submits to the CARB a report detailing its Work Program expenditures, project categories, and individual project emissions reductions and cost-effectiveness values. The MSRC staff, with considerable support provided by the AQMD's Finance Division, compiled the FY 1999-00 report for electronic submittal. The deadline is July 1, 2001. The overall cost-effectiveness is approximately $10,000 per ton of emissions reduced. This is 50% more favorable compared to the CARB-recommended cost-effectiveness guideline of $20,000 per ton of emissions reduced. In addition, the MSRC's Administrative Budget equaled 4%, well below the 5% administrative cap. The MSRC unanimously received and approved the FY 1999-00 Report to ARB. The AQMD Board will consider reports for all three parts of the AB 2766 Program within the consent calendar of the July 20, 2001 Governing Board agenda.

Contract Modification Requests
The MSRC unanimously approved with conditions payment of the 20% retention on Los Angeles Department of Transportation Contract #95030C, which is for the purchase of four electric buses in the amount of $504,000. The retention will be released only when the City of Los Angeles provides proof that the vehicle has been certified and the engine installed in the buses.

In a separate action, the MSRC also approved inclusion of language in the boilerplate contract for AB 2766 Discretionary Fund contracts that would require the use of MSRC decals on vehicles partially funded by the MSRC. The decal is intended as an outreach tool.

Contract Administrator Report
The MSRC's AB 2766 Contract Administrator provided a written status report on all open contracts from FY 1994-95 through the present. This Contract Administrator Report is attached for your information (Attachment 2).
