PROPOSAL:
Amend Rule 2011 - Requirements for Monitoring, Reporting, and Recordkeeping for Oxides of Sulfur (SOx) Emissions and Rule 2012 - Requirements for Monitoring, Reporting, and Recordkeeping for Oxides of Nitrogen (NOx) Emissions
SYNOPSIS:
The proposed amendments seek to implement a recordkeeping streamlining recommendation from the Monitoring, Recordkeeping and Reporting (MRR) Task Force. The proposed amendments provide facilities with an added option of using an electronic or computer data storage system to a strip chart recorder for the purpose of complying with recordkeeping requirements. Additionally, the proposed amendments clarify the requirement for computer printout of data recorded by the remote terminal unit. The proposed amendments will increase flexibility and enhance enforcement of Rules 2011 and 2012.

Background
On October 15, 1993, the AQMD Governing Board adopted the RECLAIM program. The rules have been amended a few times over the last seven years. The amendments have addressed three types of concerns: technology assessments, EPA issues for rule approval, and minor technical adjustments. The proposed rule amendments seek to implement the recommendation to provide an alternative form of recordkeeping to strip chart recorders, as proposed by the Monitoring, Recordkeeping, and Reporting (MRR) Task Force. In April 1999, the Governing Board established the MRR Task Force to develop and present back to the Board specific recommendations on how to streamline the MRR requirements for facilities subject to certain AQMD regulations including Regulation XX Regional Clean Air Incentives Market (RECLAIM). At its April 2000 meeting, the MRR Task Force submitted its recommendations on streamlining RECLAIM monitoring and reporting requirements. The Board directed staff to implement the recommendations. Therefore, these proposed amendments were developed to allow alternative recordkeeping systems as well as satisfy the requirement of H&SC Section 39616(c)(5) that requires "The program [RECLAIM] will promote the availability of data in computer format. The District shall endeavor to provide sources with the option to keep records by way of electronic or computer data storage systems, rather than mechanical devices such as strip chart recorders."
Proposal
The proposed amendments to Regulation XX assist in effective program implementation. The most significant proposals will:
Add language to allow the use of electronic recorders as an alternative form of recordkeeping to strip chart recorders; and
Clarify the requirement for computer printout of data recorded by the remote terminal unit (RTU).
AQMP & Legal Mandates
The proposed rule amendments will not have an effect on emissions.
CEQA & Socioeconomic Analysis
Pursuant to CEQA, staff has prepared a draft Notice of Exemption (NOE) for the proposed amendments to Rules 2011 and 2012. In addition, the proposed amendments to the rules clarify and modify rule language for the purpose of ensuring consistency among all the rules in Regulation XX and to provide increased compliance flexibility. As a result, there will be no significant cost impacts from the proposed amendments.
Implementation Plan
The proposed amendments do not appreciably change the RECLAIM program and are not expected to change the implementation of RECLAIM rules. As always, staff will be available to assist those facilities affected by the proposed amendments.
Resource Impacts
Implementation of these proposals will have no impact on the AQMDs permitting process and will not require additional resources.
