PROPOSAL:

Confirm Clarifying Language Added to Rule 1309.1 – Priority Reserve to Reflect Board’s Direction Adopted at April 20, 2001 Public Hearing.

SYNOPSIS:

At the April 20, 2001 Public Hearing, the Board adopted the staff proposal to amend Rule 1309.1 with a stipulation that the Electric Generating Facilities utilizing the District’s PM-10 Priority Reserve account sign long-term contracts with the state, and allocate the power generated to the state grid system.

RECOMMENDED ACTION:

Receive and file the rule language and confirm rule implementation guidance for Rule 1309.1(a)(4)(E).

At the April 20, 2001 Public Hearing, the Board adopted the staff proposal to amend Rule 1309.1 with a stipulation that the Electric Generating Facilities (EGFs) utilizing the District’s PM-10 Priority Reserve account sign long-term contracts with the state, and allocate the power generated to the state grid system.

Staff has drafted the attached revised rule language which reflects the exact words of the motion regarding long-term contracts. In addition, staff has also prepared a rule interpretation to ensure consistency with the Board’s intent and direction. Attachment B details the requirements for facilities to satisfy the criteria for power sales to the state of California.
