PROPOSAL: 

Execute Memorandum of Agreement Establishing the Port of Los Angeles Carl Moyer Air Quality Standards Attainment Assistance Program, and Recognize and Appropriate Funds for Use on Qualifying Projects within Port Jurisdictional Boundaries

SYNOPSIS: 

Under a proposed Memorandum of Agreement (MOA), the Port of Los Angeles is offering $316,410 to the AQMD for use as local matching funds under the Moyer Program to be used for projects within the Port boundaries. As part of the MOA, the Port will assist AQMD in the review, evaluation, monitoring and reporting processes as they apply to marine applications in areas under it’s jurisdiction. This action is to approve the MOA, recognize funds of $316,410 from the Port, and appropriate these funds to the Carl Moyer Fund Account.

RECOMMENDED ACTION:

  1. Authorize the Executive Officer to enter into a Memorandum of Agreement (MOA) with the Port to establish the Port of Los Angeles Carl Moyer Air Quality Standards Attainment Assistance Program.
  1. Authorize the Executive Officer to receive $316,410 from Port of Los Angeles for the Carl Moyer Program Fund as part of the local match funds for the FY 2000-01 Carl Moyer Program.

Background

The AQMD is currently in the process of implementing the FY 2000-01 Carl Moyer Program. This year the Moyer Program allocation is comprised of: (1) $19.745 million from ARB (2) $1.1 million from CEC; and (3) $5.64 million in local match funds. California Health and Safety Code §44287(e) states that matching funds may be any funds under the district’s budget authority that are committed to be expended in accordance with the program. Funds committed by a port authority or a local government, in cooperation with a district, to be expended in accordance with the program may also be counted as district matching funds.

Proposal

The Port has proposed providing funds in the amount of $316,410, to the AQMD, for the purpose of augmenting Moyer Program funds. The Port intends to generate funds for qualifying projects or associated infrastructure within Port jurisdictional boundaries, to be used in place of, or in addition to, Moyer Program funds. An MOA between the AQMD and Port establishing the Port of Los Angeles Carl Moyer Air Quality Standards Attainment Assistance is included for Board review and approval. The MOA covers the FY 2000-01 Moyer Program only and will expire on July 31, 2003, the date by which all funds must be expended.

The MOA lays out the role of the Port in the Carl Moyer Program, and defines how funding is generated. The Port, under the terms of the MOA, will assist the AQMD in the review, evaluation, monitoring and reporting on the use of Moyer Program funds for marine industry projects in and around the Port of Los Angeles. The Port successfully completed the transaction of 8,000 NOx Reclaim Trading Credits for a total of $316,410 in January of this year. The AQMD has designated funding in the marine and port applications category in the amount of $1-2 million. The Port and Port tenants may also qualify in other program categories. It is likely that the Port area will receive a significant return on the local match funds provided under the MOA. Staff will also inquire with the Port of Long Beach about creating a similar MOA for its jurisdiction.

Benefits to AQMD

The MOA brings additional expertise in the marine projects area, and provides for additional resources to review, monitor and report on the status of funded projects. Additional funding provides AQMD with the opportunity to increase the voluntary, near-term, reductions in emission of NOx that are necessary to meet its clean air commitments under the State Implementation Plan.

Resource Impacts

The proposal creates a positive resource impact. Additional staff assistance in review, evaluation, monitoring and reporting will free up AQMD staff to work in other areas, thus improving staff efficiency.
