Approval of Minutes of April 25, 2002 Meeting
Minutes from the April 25, 2002 meeting were unanimously approved, as submitted. The minutes are attached for your information (Attachment 1).
Annual Election of MSRC Chair and Vice Chair
The MSRC's Operational Policies and Procedures call for the annual election of the MSRC chair and vice chair in May. The MSRC unanimously re-elected the current chair and vice chair for another one-year term. Palm Springs Mayor Will Kleindienst, representing the RCTC, was re-elected chair; Bradbury Council Member Bea LaPisto-Kirtley, representing the LACMTA, was re-elected vice chair. At the May 9, 2002 meeting of the MSRC's Technical Advisory Committee (MSRC-TAC) Diana Kotler, representing the Orange County cities, was elected as the MSRC-TAC's chair, and Marilyn Williams, representing the RCTC, was re-elected as the MSRC-TAC's vice chair. There will be a three-month period during which Doug Kim will transition the MSRC-TAC chair position to Ms. Kotler.
FY 2002-03 Work Program in Concept
At its February 2002 retreat the MSRC identified priority categories for funding. From that list, the MSRC-TAC developed a FY 2002-03 Work Program in Concept, the elements of which were considered by the MSRC at its May 23, 2002 meeting. At the conclusion of its meeting, the MSRC adopted a Work Program in Concept totaling $14,950,000, including use of its reserve with the recognition that turn-back funds will provide a revenue cushion, with the following categories and funding allocations:
Clean Fuels ($11.2 million)
TCMs ($1.25 million)
Coachella Valley PM10 Reduction Program ($1 million)
Expanded Freeway Service Patrols ($1.5 million)
The MSRC will consider solicitations for the above categories in two portions, in July and August 2002, respectively. The Board will consider the FY 2002-03 Work Program in Concept along with the first portion of solicitations at its August 2002 meeting under the consent calendar and the remaining solicitations will be presented to the Board at its September 2002 meeting under the consent calendar.
Exercising Option to Extend Technical Advisor Contract for a Second One-Year Term
In June 2001, following an RFP process, the MSRC approved a contract award for Technical Advisor Services to Raymond Gorski. The contract award for FY 2001-02 was for $135,341 and allowed for three one-year options incorporating annual 4% inflation adjustments. The Board subsequently authorized the MSRC to exercise these options. On May 23, 2002, the MSRC unanimously agreed to exercise the first-year option in the amount of $140,754 based on 1,920 hours at $73.31/hour. Of the $140,754, 75% (or up to $105,565.50) will be included as part of the FY 2002-03 Work Program and 25% (or up to $35,188.50) will be included as part of the FY 2002-03 Administrative Budget, which is adopted each year to budget the 5% administrative cap allowed by AB 2766. This contract award will be considered by the Board along with other awards as part of the FY 2002-03 Work Program later this year.
Approval of FY 2002-03 Administrative Budget
Every May the MSRC considers an Administrative Budget for the next fiscal year, as a projection of the 5% administrative cap provided by the law. The MSRC unanimously approved the FY 2002-03 Administrative Budget totaling $590,349 (almost $43,000 below the statutory cap). As mentioned above, the Administrative Budget includes 25% of the Technical Advisor's contract, or an amount not to exceed $35,188.50, and $36,000 for miscellaneous expenditures, such as printing and mailing costs, computer upgrades and equipment for MSRC staff, and office supplies.
Adoption of Revised Policy Regarding MSRC Appointments and Alternates
In late 1999 an issue arose at an MSRC meeting about representatives serving two different entities. At that time a policy was adopted precluding this occurrence. Specifically, the policy stipulated that "a MSRC member may not serve as a member for one agency and an alternate for another agency." More recently a similar issue arose about a representative serving as the MSRC alternate for two different agencies. On May 23, 2002, the MSRC amended its original policy to include alternates; thus, an alternate can represent only one agency and an alternate to one member cannot serve as an alternate to another.

Contract Administrator Report
