Amend Rule 1168 – Adhesive and Sealant Applications

SYNOPSIS: 

Rule 1168 was amended at the June 7, 2002 Regular Board Meeting. The staff recommendation was adopted with the exception of that portion regarding the VOC limits for adhesives used for shoe and handbag repair. Consideration of the VOC limits for shoe and handbag repair was continued to the July 12, 2002 Regular Board Meeting.

Adopt the attached resolution amending Rule 1168 Adhesive and Sealant Applications and adopting the Statement of Findings and Overriding Considerations.

Background

After holding a public hearing on June 1, 2002, the Governing Board adopted amendments to Rule 1168 – Adhesive and Sealant Applications, but continued its deliberation on proposed amendments for adhesives used for shoe and handbag repair. As part of its testimony, staff had proposed to extend the future effective date of the VOC limit for shoe and handbag repair adhesives to January 1, 2009. Because of the one-year product sell through provision currently in effect, the use of high VOC shoe and handbag repair adhesives was effectively extended to 2010. Staff also committed to conduct a further technology assessment, develop an implementation working group and complete a technology advancement project for shoe repair adhesives as part of the adopting resolution.

An alternative proposal to completely exempt the shoe and handbag repair industry permanently was also discussed. The Board was unable to obtain the necessary majority votes to pass either proposal, and therefore deferred further deliberations to the next Board meeting.

Members of the Board unable to attend the June meeting have subsequently been provided with tapes of the hearing for their review so they may participate in the upcoming discussion. Public testimony on this item has been concluded since the hearing has been closed.
