ACTION ITEM
CEQA Contract
At its April 5, 2002 meeting, the Board approved the release of an RFP to secure assistance within the preparation of preparing environmental analyses as required by CEQA. Seven proposals were received and reviewed by a qualified panel. All proposals met the minimum requirement for technical merit and were further evaluated and scored according to costs, which were based on consultant staff salaries weighted by the percentage of time each staff classification was expected to work on future AQMD projects. It is recommended that the most qualifiedhighest scoring consultants be awarded time and materials contracts, divided between the consultants in an amount not to exceed $150,000. Staff recommends awarding contracts with Environmental Audit, Inc. for $50,000; ENSR International for $50,000; and Jones & Stokes for $50,000. Funds for this proposal in an amount not to exceed $150,000 are available in the Planning, Rule Development and Area Sources FY 2001-02 Budget.
Committee Member Jane Carney moved to recommend approval of this item to the Governing Board and Committee Chair seconded. The motion was passed unanimously.
INFORMATION ITEMS
Submittal of Implementation Status of the PM10 Portion of the 1997 AQMP and
PM10 Budgets for Transportation Conformity Use
Staff outlined the need to submit an updated implementation status to U.S. EPA for the PM10 portion of the 1997 AQMP. It is necessary for the U.S. EPA to approve the PM10 portion of the 1997 AQMP in order to extend the attainment deadline for SCAB from 2001 to 2006, authorized under the federal Clean Air Act (CAA). The 1997 AQMP met the CAA requirements of most stringent measures and expeditious attainment demonstration to qualify for the extension. As part of this submittal, PM10 emission budgets for transportation conformity purposes and milestone year emissions are also provided based on the updated implementation schedule. Furthermore, AQMD will commit to revise the PM10 Plan in 2003 using the latest planning assumptions and motor vehicle emission model.
Status Report on Coachella Valley PM10 SIP
Staff gave a status report on the 2002 Coachella Valley PM10 State Implementation Plan (2002 CVSIP), .having She had previously briefed the Committee on January 25th and April 26th. The draft 2002 CVSIP was released on May 10th. A public workshop was held on May 23rd in Palm Desert. It was attended by 140 people; and 16 people formally commented, including developers, farmers, government staff, and the public, formally commented. The comments included concerns about sand from the nature preserves and other government lands, a perceived lack of enforcement, perceived undue focussing of control on particular sources (e.g. farming, development), and questions about the technical information underlying the plan and control strategies. Staff has also been in discussion with EPA and ARB staff. Early comments by those agencies have already been addressed in the draft CVSIP. EPA's comments on the draft CVSIP are limited to 5five areas, which staff feels can be addressed in the draft final. The close of comments for the draft CVSIP is June 7th (the close of comments on the draft Negative Declaration is May 31st). Staff will make appropriate changes in response to agency and public comments in the draft final of the 2002 CVSIP, which will be in the Board package. The special Board hearing will be at 9:30am on June 21st, at CC-8 (AQMD headquarters) and Conference Room 119 near CVAG's headquarters in Palm Desert.
Advanced Air Pollution Research Plan for FYs 2002-03, 2003-04, and 2004-05
Staff presented an overview of the draft Advanced Air Pollution Research Plan to implement the Strategic Alliance Initiative No. 5- Strategic Alliance for Advanced Air Pollution Research. The draft Research Plan is an agency-wide plan that outlines research projects to be pursued over the next three fiscal years. The draft Research Plan would provide overall technical support for development of regulatory programs, monitoring progress towards attainment, and rule compliance. The draft Research Plan proposes 83 research projects that cover eight research elements: health impacts, air toxics exposure, air quality management planning, technology advancement, technical support for rule development/implementation, enhancements to current enforcement/compliance monitoring tools, enhancements to laboratory and source testing procedures, and special topics. The draft Research Plan provides a budget estimate of about $9 million to $10 million on an annual basis.
A steering committee was convened to provide initial input and review of the draft Plan, and three regional consultation meetings were held. Staff will be taking the draft Research Plan to the Governing Board for its approval at the June 2002 public meeting.
AB2766 Annual Status Report
The reports purpose is to present the outcome of FY 00/01 AB2766 Subvention Fund usage and program results to CARB, local governments and other entities. Historically, AB2766 was signed into law September 1990. It authorizes a $4 motor vehicle registration fee surcharge of which 40% is subvened to local governments to implement projects that reduce mobile source emissions.
Staff reported on the Subvention Funds financial summary relative to the beginning balance ($25.7 mill), funds received ($17.0 mill), project spending ($18.4 mill), earmarked funds ($17.6 mill), and funds remaining after earmarking ($8.1 mill). Also, staff reported on the number of projects funded and quantified over the last four fiscal years. During FY 00/01 399 projects were funded, of which 206 were quantified for emission reductions. Expenditures in 11 of the project categories indicated that Transportation Demand Management, Traffic Management and Alternative Fuels had the highest spendingexpenditure with Public Education and Market Based Programs having the least. A total of 26,986 lbs. (13.48 tons) of emissions (NOx, ROG, PM10 and CO/7) per day were reduced through implementation of the 399 projects. Cost-effectiveness ranged from
$.02-$842/lb for the various projects funded. Staff reported that overall average cost-effectiveness is less than $2/lb.
AQMD staff provided outreach to local government staff in the form of meetings, telephone calls and training sessions. The overall summary of accomplishments presented by staff indicated an increase in emission reductions, cost-effectiveness, project quantification, and use of the automated diskette. Earmarked funds waswere the only area that did not reflect an increase. Staffs key activities for FY 2002/03 will focus on continuing to provide proactive technical assistance to local governments, continuing to interface with CARB, increasing assistance to Coachella Valley cities, and placing emphasis on TEA-21(CMAQ) co- funding opportunities. The full staff report will be presented to the Governing Board at the July 12, 2002 Meeting and upon its approval will be forwarded to
CARB.
There was a motion made by Committee Member Jon Mikels to have the Legislative Committee pursue development of legislation that would require local governments to fund only projects with quantifiable reductions and quantify such reductions, and that the reductions be captured by the AQMD for SIP attainment demonstration purposes. The motion was seconded by Committee Member Norma Glover and approved by the Committee. Further discussion by the committee members reflected direction to staff to include language in the AB2766 Staff Report to acknowledge the above intent.
