Below is a summary of key issues addressed at the MSRC’s April 25, 2002 meeting. The next committee report will summarize the MSRC's Thursday, May 23, 2002 meeting.

Approval of Minutes

Minutes from the March 28, 2002 meeting were unanimously approved, as submitted. The minutes are attached for your information (Attachment 1).

Approval of Additional Awards as Part of the FY 2001-02 AB 2766 Discretionary Fund Work Program

In November 2001 the AQMD Board approved funding in the amount of $10,634,729 for 29 transportation control measure and clean fuels heavy-duty vehicle projects as part of the FY 2001-02 AB 2766 Discretionary Fund Work Program. Subsequent to that action, the AQMD Board approved on three separate occasions three projects totaling $994,500 under the Diesel Particulate Trap Retrofit Program, $48,000 for two Rideshare to Rails projects, and fifteen applications totaling $2,526,584 under the Local Government Match Program, all as part of the FY 2001-02 Work Program. However, there remained several eligible projects under both the Diesel Particulate Trap Retrofit Program and the Alternative Fuels Transit Bus Program that could not be funded due to lack of available monies. Those projects were placed on waiting lists in case monies became available. At its April 25, 2002 meeting, the MSRC recognized turnback funds and a residual balance totaling nearly $1 million. Consequently, the MSRC approved funding two additional projects from the particulate trap waiting list, one for $280,500 to Long Beach Transit and one for $340,000 to the County of Riverside, and additional transit buses for the Los Angeles County Metropolitan Transportation Authority from the transit bus waiting list. MTA was previously awarded $2,336,708 for 210 alternative fuel transit buses. The second award will be in the amount of $321,467 for 28 additional alternative fuel transit buses. The Board will consider these awards on June 7, 2002, under the consent calendar as part of the FY 2001-02 Work Program.

FY 2002-03 Work Program in Concept

The MRSC heard presentations on the FY 2002-03 Work Program in Concept, but was unable to adopt a program when a quorum was lost. The MSRC's May 23, 2002, has been scheduled an hour earlier at 12:30 p.m. to consider the Work Program in Concept, which will be presented to the Governing Board along with multiple solicitations in July.

Reimbursement of Trip Reduction Plan Fees by School Districts

When school districts are required to file a trip reduction plan, they are exempt from paying filing fees, which are instead paid out of the Discretionary Fund per the Health & Safety Code section 44246. Staff reported to the MSRC under its consent calendar that they would have to pay $918.96 in filing fees since Culver City School District was required to file a trip reduction plan this year.

Legislative Issues

Last month I reported that the MSRC adopted an Oppose position on Senate Bill 1827 (Torlakson), which would have required a portion of AB 2766 monies to be allocated towards specific local transit projects. Subsequently, on April 25, 2002, the author dropped the bill before hearing. In addition, Assembly Bill 2774 (Hadley), which would previously have allowed electric vehicles to drive in carpool lanes, has been amended to instead create a task force for public outreach and education of alternative fuel vehicles. The task force membership consists of five representatives, including one appointed by the MSRC. AB 2774 is currently waiting to be heard by Appropriations.

Contract Modification Requests

The MSRC considered only one contract modification at its April 25, 2002 meeting. The City of Los Angeles asked for two amendments to their contract, #PT0201. First, they wanted to be allowed to replace the 50 vehicles originally included in their application under the particulate trap program. The MSRC unanimously approved this request since the new vehicles also met the program criteria. Second, since the City was able to negotiate a considerable reduction in price on its particulate traps, they requested that they be allowed to use the residual monies to purchase 24 more traps. After some discussion, the MSRC approved this second request in order to realize additional emissions reductions for the same contract value.

Contract Administrator Report

The MSRC's AB 2766 Contract Administrator provided a written status report on all open contracts from FY 1995-96 through the present. This Contract Administrator Report is attached for your information (Attachment 2).
