PROPOSAL: 

Submittal of Implementation Status of the PM10 Portion of the 1997 AQMP and PM10 Emissions Budgets for Transportation Conformity Use

SYNOPSIS: 

As part of its 1997 AQMP submittal to EPA, the AQMD requested an extension of the PM10 attainment date from 2001 to 2006. To date, the EPA has not taken action on the PM10 portion of the 1997 AQMP. In order to facilitate the federal action, the AQMD is submitting an updated implementation schedule, PM10 emissions budgets, and a commitment to update the PM10 portion of the AQMP in 2003.

Background

In February 1993, the U.S. EPA reclassified the South Coast Air Basin (Basin) and Coachella Valley as "serious" non-attainment areas for PM10. The federal Clean Air Act (CAA) specified that a PM10 State Implementation Plan (SIP) must be submitted to U.S. EPA four years from that reclassification date. The CAA also requires the Basin to attain the federal primary ambient air quality standard for PM10 by December 31, 2001, with a provision for one extension of up to five years. To meet the requirements of the CAA for PM10, the AQMD developed the 1997 Air Quality Management Plan (AQMP), which also included a request to U.S. EPA to approve the five-year extension to achieve federal PM10 standards. The PM10 control strategy set forth in the 1997 AQMP includes the most stringent measures and the best available control measures and is designed to achieve federal PM10 standards by December 31, 2006.

The ozone portion of the 1997 AQMP was revised in 1999, and submitted to CARB and U.S. EPA for approval. However, to date, the PM10 portion of the 1997 AQMP has not been approved by U.S. EPA and no action has been taken by the agency regarding the PM10 portion of the 1997 AQMP including approval of the five-year extension to attain the primary ambient air quality PM10 standards. To expedite approval of the PM10 portion of the 1997 AQMP, the AQMD staff is submitting to CARB and U.S. EPA for a concurrent review an updated implementation schedule of the 1997 AQMP control measures and PM10 emissions budgets for transportation conformity. In addition, the PM10 portion of the AQMP including the emissions budgets will be updated in 2003, using the latest motor vehicle emission model and planning assumptions.

Updated Implementation Schedule

Attachment B includes an updated implementation schedule for control measures in the 1997 AQMP (Table 1) as well as the CARB’s and U.S. EPA’s adopted measures beyond 1994/1997 SIP Ozone Commitments with possible PM10 air quality benefits (Table 2). Table 2 measures are being provided by AQMD to U.S. EPA for informational purposes only and are not proposed to be considered as updates to the Ozone SIP at this time. For each control measure in the 1997 AQMP, the adoption and implementation date committed in the 1997 AQMP as well as the current status are identified. Although some of the adoption and implementation dates have been revised, there would be no significant air quality impact in 2003 and no changes in the attainment demonstration in 2006. The following table contains the PM10 milestone targets for 2003 and 2006 based on the updated implementation schedule. This table replaces Table 6-1 of the 1997 AQMP.

Emissions Budget

Attachment C includes emissions budgets for PM10, NOx, and VOC for 2003, 2006, 2010, and 2020. The emissions budgets presented in Attachment C are based on the emissions inventory in the 1997 AQMP after implementation of the control measures. Under federal law, the AQMD staff submitted emissions budgets for each milestone year to 2006 (2006 is the attainment year for PM10) as part of the 1997 AQMP. The emissions budget is used in conformity findings by other regulatory agencies. Conformity determinations for years after the attainment year are not required by U.S. EPA and are typically based on the emissions budgets for the attainment year. Emissions budgets after the attainment year may be submitted to U.S. EPA for transportation conformity purposes, provided attainment demonstration is made.

Attachment D includes the 1997 AQMP primary PM10 control measures and the corresponding emissions reduction commitments in 2003 and 2006. For control measures not adopted yet, the commitments reflect the current rule development schedule in 2002.

Recommendation

The AQMD staff recommends that the Board approve the updated implementation schedule and the emissions budgets (including the primary PM10 control measure commitments) for submittal to CARB and U.S. EPA for a concurrent review in order to expedite U.S. EPA’s approval of the PM10 portion of the 1997 AQMP. In addition, the AQMD staff recommends that the Board direct staff to update the PM10 portion of the AQMP (including the emissions budgets) in 2003 as part of the 2002 AQMP revisions.

RESOLUTION NO. 02-

                    A Resolution of the South Coast Air Quality Management District Governing Board to Approve the Updated Implementation Schedule for the PM10 Portion of the 1997 Air Quality Management Plan and PM10 Emissions Budgets for Transportation Conformity Use.

                    WHEREAS, the South Coast Air Basin is classified as "extreme" non-attainment for ozone, "serious" non-attainment for fine particulate matter (PM10) and carbon monoxide in accordance with the federal Clean Air Act; and

                    WHEREAS, the South Coast Air Basin has been redesignated as "serious" non-attainment for PM10 in accordance with the federal Clean Air Act; and

                    WHEREAS, the South Coast Air Quality Management District ("District") Governing Board adopted the 1997 Air Quality Management Plan (AQMP) and the 1997 AQMP was submitted to the U.S. Environmental Protection Agency to satisfy the requirement of the federal Clean Air Act that a PM10 attainment demonstration plan be submitted for areas designated as "serious" non-attainment for PM10; and

                    WHEREAS, the 1997 AQMP demonstrates that the South Coast Air Basin will attain the federal PM10 air quality standards by 2006; and

                    WHEREAS, the California Air Resources Board approved the 1997 Air Quality Management Plan on January 23, 1997 and submitted the 1997 Air Quality Management Plan to the U.S. Environmental Protection Agency for its approval on February 5, 1997; and

                    WHEREAS, 40 CFR Part 93 requires that emission budgets for criteria air pollutants be specified in the State Implementation Plan (SIP) for transportation conformity use; and

                    WHEREAS, 40 CFR Part 93 does not require emission budgets beyond the criteria air pollutant attainment year; and

                    WHEREAS, the 1997 AQMP provides emission budgets after implementation of the AQMP control measures; and

                    WHEREAS, the South Coast Air Quality Management District is committed to comply with the requirements of the federal Clean Air Act; and

                    WHEREAS, a notice of public hearing was released and published 30 days prior to June 7, 2002; and

                    WHEREAS, 40 CFR 93.118(e)(4)(iv) requires a demonstration that transportation emission budgets submitted to the U.S. Environmental Protection Agency are "consistent with applicable requirements for reasonable further progress, attainment, or maintenance (whichever is relevant to the given implementation plan submission);" and

                    WHEREAS, the 1997 Ozone SIP was amended in 1999 and was subsequently submitted to CARB and U.S. EPA for approval; and

                    WHEREAS, the U.S. EPA has not taken formal action on approval of the PM10 portion of the 1997 AQMP, including the five-year extension request (from 2001 to 2006) for PM10 attainment demonstration; and

                    WHEREAS, the District has updated the implementation status of control measures in the 1997 AQMP and although some adoption and implementation dates have changed, these changes are not expected to interfere with attainment demonstrations (Attachment B); and

                    WHEREAS, the emission reduction commitments in the 1997 AQMP have been met through actions by District, CARB, and U.S. EPA; and

                    WHEREAS, the PM10, NOx, and VOC emission budgets are based on the 1997 AQMP (Attachment C); and

                    WHEREAS, the updated implementation schedule and the emission budget will be submitted to CARB and U.S. EPA for a concurrent review in order to expedite EPA’s approval of the PM10 portion of the 1997 AQMP.

                    NOW, THEREFORE, BE IT FURTHER RESOLVED, that the South Coast Air Quality Management District Governing Board approves this Resolution, updated implementation status of the 1997 AQMP control measures and the emissions budgets (including the primary PM10 control measure commitments), and directs the Executive Officer to forward a copy to the California Air Resources Board and the U.S. Environmental Protection Agency for concurrent review; and

                    BE IT FURTHER RESOLVED, that the South Coast Air Quality Management District Governing Board directs the Executive Officer to update the PM10 portion of the AQMP including emissions budgets in 2003 as part of the 2002 AQMP revisions using the latest approved motor vehicle emissions model and planning assumptions; and

                    BE IT FURTHER RESOLVED, that the South Coast Air Quality Management District Governing Board finds that the emission budgets are "consistent with applicable requirements for reasonable further progress, attainment, or maintenance (whichever is relevant to the given implementation plan submission);" pursuant to 40 CFR 93.118(e)(4)(iv).
