Rule and Control Measure Forecast

This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2002.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month’s forecast are summarized.

Rules to be Rescheduled/Removed and Added
 

Rule 1122 Solvent Degreasers
Proposed amendments to Rule 1122 are being rescheduled from to-be-determined to December 2002 calendar. Section (k)(1)(d) provides a small capacity/small surface area exemption for 8 specific parts cleaning operations. This exemption expires on January 2003. A recently completed technology assessment has indicated that some of these operations may need to continue to be exempt. The proposed amendments will address the sunset date accordingly.

Rule 1133 and Related Rules Emission Reductions from Composting Operations (CM#99 WST-02)
Proposed amendments to Rule 1133 are being rescheduled from July 2002 to October 2002. Based on comments received at the April 5, 2002 Board pre-hearing on the PR 1133 Technical Assessment, staff proposes to delay presentation of Phase 1 of PR 1133 until the October Board hearing. Per Board direction, PR 1133 will ultimately be divided into separate proposed rules for controls on specific sources (e.g., greenwaste-only composting, co-composting, chipping/grinding operations). Phase 1 of these separate proposed rules will be considered at the October meeting.
Rule 1610 Old-Vehicle Scrapping
Proposed amendments to Rule 1610 are being rescheduled from to-be-determined to November 2002 calendar. This action has been triggered by the upcoming adoption of a new model rule by CARB and this requires district conformance within 6-month of adoption. CARB is expected to formally adopt the new rule by June 2002.
Rule 1631 Pilot Credit Generation Program for Marine Vessels
Proposed amendments to Rule 1631 are being rescheduled from June 2002 to July 2002 to allow adequate consultation with CARB and U.S. EPA to ensure SIP approvability.
Rule 1421 Control of Perchloroethylene Emissions from Dry Cleaning Systems
Proposed amendments to Rule 1421 are being rescheduled from May 2002 to summer 2002 to allow additional time to address stakeholder concerns.

Below is a list of all rulemaking activity scheduled for the year 2002. The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source-specific toxic-related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located at the end of the report (Attachment D).
