SYNOPSIS: 

The Stationary Source Committee met Friday, August 23, 2002. Following is a summary of that meeting. The next meeting will be September 27, 2002, at 10:30 a.m., in Conference Room CC8.

Attendance

The meeting began at 10:40 a.m. Present were Norma Glover, acting Committee Chair, Jon Mikels and Leonard Paulitz (arrived at 10:44). Absent were Ron Loveridge, Committee Chair, Jane Carney, and Cynthia Verdugo-Peralta.

INFORMATIONAL ITEMS

  1. Rule 1610 – Old Vehicle Scrapping
    Lee Lockie, Director of Area Sources presented this item. The proposed amendments will modify Rule 1610 to be consistent with CARB’s recently amended statewide vehicle scrapping requirements. The amendments include the following: an extension of vehicle eligibility; changes to Smog Check and vehicle registration-related requirements; updates to emission credit values for scrapped vehicles; and clarification and administrative changes, including new definitions.

  2. Status Report on Rule 1113 – Architectural Coatings
    Lee Lockie, Director of Area Sources, reported on the status of Rule 1113, Architectural Coatings. On June 24, the Court of Appeals of the State of California Fourth Appellate District, Division Three, ruled that the May 14, 1999 amendments to Rule 1113 were not properly adopted. District Counsel has filed a petition for review to the California Supreme Court to review this decision. In the interim, staff is preparing to re-propose the previously-adopted amendments along with revisions to the interim compliance dates and certain clarifications to reflect the original intent of the rule, as well as to address issues raised by CARB and EPA. She indicated that the staff report will include updated information on compliant product availability and performance. The public hearing before the Board has been scheduled for November 1, 2002.

  3. Update Minor Source BACT for Emergency Diesel Engines
    Howard Lange, Air Quality Engineer I, Technology Advancement, presented this item. The BACT Team proposes to update the minor source BACT (MSBACT) guidelines for emergency diesel engines to be consistent with USEPA regulations for nonroad engines and with Rule 431.2, maximum sulfur content of liquid fuels. Emergency diesel engines are used to drive backup generators, fire pumps, etc., and are restricted to 200 hours per year. Tier 1 of the USEPA nonroad emission standards are in effect now for all engine sizes, and Tier 2 standards are phasing in. The Tier 2 standards require significantly lower emissions than the Tier 1 standards. The proposal is to update the MSBACT from the Tier 1 standards to the Tier 2 standards. However, an exemption is included for fire pumps unless/until Tier 2-compliant fire pump engines are available. Rule 431.2 presently limits sulfur content in liquid fuels to a maximum of .05 wt.%, but as of June 1, 2004 this limit drops to .0015 wt.%. MSBACT currently includes the .05 wt.% limit. The proposed update would add the future .0015 wt.% limit. This proposed change complies with all internal AQMD criteria for updating MSBACT and also meets all applicable requirements in SB 456 (Kelly).

  4. Penalties Assessment Trends
    Peter Mieras, District Prosecutor, presented this item on penalty assessment trends for major and minor source violations. Mr. Mieras provided information showing that average penalties levied against small businesses have not risen over the past years although the number of violation notices has increased with the increase in field inspections conducted by Engineering and Compliance.

    John Billheimer commented that he is still interested in information regarding targeting businesses for inspection. Carol Coy, Deputy Executive Officer for Engineering and Compliance stated that the past three years the emphasis has been on re-establishing a field compliance inspector presence at all business types based on community-based deployment. Leonard Paultiz said that Management is putting resources where they belong.
