PROPOSAL:

Establish Rule 1173 Mitigation Fund

SYNOPSIS:

Recent amendments (December 2002) to Rule 1173 for Refineries and Chemical Plants established a mitigation fee payment provision relating to the release of VOC from an atmospheric Pressure Relief Device(PRD). This action is to establish a Special Revenue Fund to account for these Rule 1173 mitigation fee payments.

Background

Rule 1173, amended December 6, 2002, established a mitigation fee provision relating to the release of VOC from an atmospheric Pressure Relief Device (PRD). The purpose of these mitigation fee revenues is to fund air quality projects which directly benefit the community surrounding the facility. To properly account for and track revenues and projects funded from this source, staff is recommending the establishment of a special revenue fund.

Resource Impacts

The impacts to the AQMD budget associated with initiating and monitoring projects funded by Rule 1173 mitigation fees are projected to be minor and within the resources currently allocated for FY 2003-04.
