This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2004.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month's forecast are summarized.

Rules to be Rescheduled/Removed and Added
 

1112.1

Emissions of Particulate Matter from Cement Kilns

Rule 1112.1 is being moved from TBD to the 1st quarter of 2005 to address the need for an alternative form of the CO limit applicable to cement kilns.

Control of Emissions from Underfired Charbroiler Restaurant Operations (PRC-03, Phase II)

Rule 1138.1 is being removed from the rules forecast report. Staff will provide a report to the Governing Board in December with a recommendation that a rule not be developed at this time.

Plastic, Rubber, and Glass Coatings (CTS-10)

Rule 1145 is being moved from September to December to allow additional evaluation of the proposed amended standards and their impact on emissions.

Rule 1146.2 is being added to the calendar for January 2005.

Adhesive and Sealant Applications

Rule 1168 is being added to the schedule for January 2005 to incorporate the conclusions of a recent technology assessment.

Community Bank & Priority Reserve

Rule 1309.1 is being added to the calendar for the 3rd quarter of 2005 to evaluate the feasibility of allowing publicly owned bio-solids processing facilities to have access to the Priority Reserve for their offset needs.

Control of Emissions from Spray Operations Using Chromium

Rule 1469.1 (previously Rule 1468) is being moved from September to November to provide more time for technical analysis and working with stakeholders. CARB is currently working on a statewide ATCM that addresses thermal spraying operations containing chromium. Staff analysis indicates that there would be no overlap between PR1469.1 and thermal spray. The ambient tests near wet spraying operations show the need to examine ways to reduce chromium emissions. Therefore, staff is proposing to initiate a rulemaking process to reduce toxic emissions from wet spraying operations. A subsequent rule will address thermal spraying operations and incorporate the proposed state Air Toxic Control Measures (ATCM).

2007

Trading Requirements

Rule 2007 is being scheduled for the September Governing Board meeting. This rule was previously part of a package of RECLAIM rules that, as described below, will follow later this year. Amendments to Rule 2007 are proceeding in advance of the other changes to continue existing trading restrictions for power plants, which would otherwise be lifted September 1, 2004.

Regional Clean Air Incentives Market (CMB-10)

An informational hearing to discuss key issues associated with the proposed amendments to RECLAIM is being scheduled for the September Board meeting. Amendments to RECLAIM rules are being rescheduled from September to November to enable additional stakeholder input.

SB-700 (Misc. Rules)

 

SB-700 (Misc. rules) is being moved from TBD to the 1st and 2nd quarters of 2005 to meet the requirements of SB-700 Air Quality (Florez).

Below is a list of all rulemaking activity scheduled for the year 2004. The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source-specific toxic-related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located at the end of the report (Attachment D).

Reg.I, II, IV, IX, X, XI, XIV, XX and XXV Rules

Various rule amendments needed to achieve AQMP emission reduction requirements and other requirements of state and federal law. Also, other administrative changes and various Reg. XIV rules will be evaluated for possible command-and-control rules to reduce toxic emissions as part of the Air Toxics Control Plan.
