Rule and Control Measure Forecast

This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2005.

Background

AQMD is required by State law to publish a list of all rules potentially scheduled for consideration during the coming year. This Rule and Control Measure Forecast Report is expanded for said purpose. In order to implement the 2003 AQMP, continue to reduce exposure to toxic air contaminants, and address CARB and U.S. EPA concerns, staff may potentially bring approximately 38 proposed rulemakings before the Board in 2005. As part of the adoption of the 2003 AQMP Revision, the AQMD is committed to adopting three control measures to achieve 2 tons/day of VOC and 2.1 tons/day of NOx emission reductions in 2005. There will be additional SOx and PM10 emission reduction benefits from two additional rules, the refinery flare rule and the cement plant rule, which were not completed in 2004 but staff plans to bring before the Board in 2005. In addition, as part of implementing the adopting resolution of the 2003 AQMP, staff will complete 11 feasibility analyses. Approximately eight rules or rule amendments will be considered by the Board in 2005 as strategies to reduce air toxic emissions, of which four will be designed to address railyard and locomotive emissions.

Below is a list of all rulemaking activity scheduled for the year 2005. The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source-specific toxic-related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located at the end of the report (Attachment D).
