Rule and Control Measure Forecast

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation scheduled. Scheduling changes that occurred since last month's forecast are summarized.

Progress in 2003

Significant progress was made in 2003 in the development and adoption of rules and rule amendments. Twenty-three rules were amended and six rules were adopted. With the two SIP measures adopted (i.e., WST-02 – Composting and Phase III of CTS-07 – Architectural Coatings) in 2003, the AQMD achieved approximately 15 tons/day VOC reductions. With the rulemaking efforts in 2003, the AQMD has met and exceeded the emission reduction obligations of 2003 as well as the total emission reduction obligations of 48 tons/day under the SIP settlement agreement. To date, a total of 70 tons/day of VOC reductions have been achieved under the SIP settlement agreement. However, the SIP settlement agreement still requires adoption of one remaining short-term measure, Phase III of FUG-05 – Oil Field Production Wells, which is scheduled for a January 2004 Board adoption hearing. Table 1 shows that AQMD has completely fulfilled its emission reduction obligations from both short-term and long-term measures under the 1997/1999 SIP.

Significant progress has been made in reducing air toxics. Rule 1469 - Hexavalent Chromium Emissions from Chrome Plating and Chromic Acid Anodizing Operations will result in an additional 90 percent reduction (48 pounds per year) in hexavalent chrome from metal plating operations. It is the first AQMD rule to include more stringent requirements for facilities located near sensitive receptors and homes. Rule 1426 – Emissions from Metal Finishing Operations will institute good housekeeping and operating practices and result in collection of information to assess whether future controls are needed. Additional compounds were added for evaluating risk under new source review and for health risk assessments through two amendments to Rule 1401 – New Source Review of Toxic Air Contaminants. A White Paper on Potential Control Strategies to Address Cumulative Impacts From Air Pollution was brought to the Board last year. As approved by the Board, the Cumulative Impacts Reduction Strategy (CIRS) contains 25 strategies, which include mobile and stationary source controls, strategic funding, education, pollution prevention, and partnerships with other government agencies, to further reduce local and regional toxic air pollution.

Rule Amendments will be required to meet the requirements of SB-700. Once an analysis has been conducted, specific rules will be identified. Rules will need to be amended to require agricultural sources to submit permit applications for Title V sources and sources exceeding one-half major source thresholds.

Various rule amendments needed to achieve AQMP emission reduction requirements and other requirements of state and federal law. Also, other administrative changes and various Reg.
