This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2004.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month's forecast are summarized.

Rules to be Rescheduled/Removed and Added
 

223	Facility Permit – Agricultural Facilities
A new rule will be presented in October 2004 to provide general facility permit requirements for confined animal facilities and crop operations as specified by SB 700 – Agriculture Operations.
1121	Control of Nitrogen Oxides from Residential–Type, Natural-Gas-Fired Water Heaters
Rule 1121 is being rescheduled from May to July to allow more time for technical analysis and to work with stakeholders.

Reg. IX Reg. X	Standards of Performance for New Stationary Sources (NSPS) National Emission Standards for Hazardous Air Pollutants (NESHAPS)
Regulations IX and X are being rescheduled from August to May for administrative updates to reflect federal rulemakings.
1401	New Source Review of Toxic Air Contaminants (EJ)
Per Governing Board’s action at its January Board meeting, Rule 1401 is being moved from May to an undetermined date (TBD), pending analysis by the state of the multi-pathway factor for fluorides.
1468	Control of Emissions from Spray Operations Using Chromium
Rule 1468 is being rescheduled from November to September to consider emission reduction requirements for uncontrolled equipment.
3003	Applications
Amendments will be presented in July 2004 to provide a schedule for Title V application requirements for large agricultural facilities pursuant to SB 700.

Below is a list of all rulemaking activity scheduled for the year 2004. The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source-specific toxic-related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located at the end of the report (Attachment D).
