SYNOPSIS:

The Legislative Committee held its regular meeting on Friday, February 13, 2004. The next Legislative Committee meeting is scheduled for Friday, March 12, 2004, at 8:00 a.m., in Conference Room CC8.

Attendance [Attachment 1]

The Legislative Committee met on February 13, 2003. Present were Jane Carney, Vice-Chair; and by teleconferencing, Bea LaPisto-Kirtley, Committee Chair, and Committee Members Michael Antonovich, Roy Wilson, and Bill Postmus. (Videoconferencing was not available due to technical difficulties.)

Washington Report/Update [Attachment 2]

Lynn Jacquez, AQMD Federal Legislative Representative, reported that after the President's Budget submission, her office had provided AQMD with copies of the Budget sections of interest to AQMD. In addition, Ms. Jacquez reported that the House has passed a four-month extension that will fund programs at existing levels until June 30, 2004.

Sacramento Update

Senator Richard Polanco (Ret.), Sheldon Sloan, and Allan Lind, AQMD Sacramento Legislative Representatives each provided a general update. Items of discussion included two AQMD proposed bills. The first bill would authorize the AQMD to implement a locomotive emission reduction and mitigation program. The second bill would provide funds for programs such as the School Bus Replacement and Retrofit and the Carl Moyer programs. Both bills are currently in bare-bones placeholder form, and are the subject of collaborative stakeholder dialog. Staff is working with the various stakeholders with regard to these two proposed bills. The Bay Area Air Quality Management District has sponsored a bill that would repeal the 30-year rolling model-year exemption in the Smog Check program. Committee members stated they wanted input from the antique car owner stakeholders prior to the AQMD taking a position on this bill.

It is expected that at the next meeting of this committee, bills will be available in print and the committee will be making recommendations on AQMD's position to the Board.

Ken Hudson from BP stated that he appreciated the Executive Officer's comments on the positive tone of discussions regarding the proposed legislation and AQMD's participation with the business community.
