Execute Contracts for FY 2002-03 Carl Moyer Memorial Air Quality Standards Attainment Program Using Carl Moyer and Clean Fuels Funds

SYNOPSIS:

On October 10, 2003, proposals were received in response to an RFP for the Carl Moyer Memorial Air Quality Standards Attainment Program. A total of $19,552,575 is available for awards. This amount is comprised of $8,148,088 allocated to the AQMD under Proposition 40, and $11,404,487 in returned and rollover funds resulting from returns of all previous Carl Moyer awards. The $11,404,487 is comprised of $9,071,372 in Carl Moyer funds and $2,333,115 from the Clean Fuels Fund originally designated as local match to the Moyer Program. Staff recommends Carl Moyer awards in the amount of $18,927,986. Staff also recommends $201,774 for a project from funds allocated by CARB to the AQMD Carl Moyer Fund as an inter-district project fund. In addition, staff recommends an amendment to an existing contract.

  1. Authorize the Chairman to modify the following award for the Carl Moyer Program Fund FY 2001-02 allocations:
  1. A no cost modification of the contract with California Street Maintenance to purchase 15 new LPG street sweepers instead of 15 new LNG street sweepers in the amount of $315,975, originally approved by the Governing Board on September 21, 2001.

Background

This is the fifth year of the Carl Moyer Memorial Air Quality Standards Attainment Program (CMP). The CMP provides funds on an incentive basis for the incremental cost of cleaner than required engines and equipment. Eligible projects include cleaner on-road, off-road, marine, locomotive and stationary agricultural pump engines, as well as forklifts, airport ground support equipment, and auxiliary power units. The program achieves near term reductions in emissions of oxides of nitrogen (NOx), which are necessary for the AQMD to meet the State Implementation Plan. The CMP also reduces particulate matter (PM) a component of diesel exhaust, which is identified by CARB as a toxic air contaminant.

In the spring of 2002, California voters passed Proposition 40, the California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act. Proposition 40 allocated $50 million to CARB, for a period of two years, for distribution to the air districts for projects that "affect air quality in state and local parks and recreation areas", in accordance with the Carl Moyer guidelines. Of these funds, the governor allocated $25 million to CARB for FY 2002-03. Furthermore, Assembly Bill 425 directs that 20 percent of the Proposition 40 funds be allocated for the acquisition of "clean, safe, school buses for use in California’s public schools that serve pupils in kindergarten and grades 1 to 12, inclusive. A total of $8,148,088 has been allocated to the AQMD for the CMP this year.

On October 10, 2003 proposals were received in response to RFP #P2004-04 for the Carl Moyer Memorial Air Quality Standards Attainment Program. Over $36 million in proposals were received. Table 1 shows the total amount of funds available for awards, including funds allocated to AQMD under Proposition 40, and turn back funds resulting from returns of all previous Carl Moyer awards. Table 2 shows the detailed breakdown of the turn back funds.

Proposal

Carl Moyer Program
At its August 2003 meeting, the Board approved release of RFP #P2004-04 to solicit projects for vehicles and equipment, including refuse haulers, on-road trucks, transit buses, marine vessels and port applications, and construction and other equipment under the Carl Moyer program. New engines and retrofits are allowed within the program. Diesel to diesel repowers have only been funded in the off-road sector provided no feasible alternative fuel engine is available. Alternative fueled projects are given preference over all other proposals. Proposal submissions have been reviewed and ranked in all categories. Due to past difficulty in ensuring that certain types of marine vessels stay within the AQMD’s boundaries, fishing and charter type vessels were given the least priority for funding.

RFP# P2004-04, which issued on August 1, 2003, to solicit proposals under the Carl Moyer Program, proposed allocation of minimum amount of funding for the following on- and off-road categories:
 

On-road heavy-duty trucks  $4.0 million
Transit buses  $1.3 million
Marine vessels  $2.0 million
Construction equipment  $2.0 million
Forklifts  $1.0 million
Locomotives  $2.0 million

Since the issuance of the RFP additional funding has become available due to turn back funds from previous years.

All the proposals have been evaluated for cost effectiveness. Staff recommends awarding fifty percent of funds to projects located in disproportionately impacted areas, and the remaining balance to projects based on their cost effectiveness in each category. In the on-road category of heavy-duty trucks and transit buses all the submitted proposals totaling $4,027,841, which is less than the allocated amount in the RFP have been recommended for awards. In the off-road category no qualifying proposals were received for forklifts. The recommended awards in the marine, locomotive, and construction equipment categories are $2,508,851, $6,094,265, and $6,297,029 respectively. These awards exceed the minimum allocation amounts in each category as outlined in the RFP. Staff recommends the majority of the extra funding for approximately equal distribution between the locomotive and construction equipment categories. The reason marine vessels are not recommended for as much funding is that marine vessels have received substantive funding in the past and many vessels were fishing vessels for which it is difficult to enforce program requirements.

As in the past, at least 50% of funds must be spent in disproportionately impacted (DI) areas. In the evaluation process, staff first funded proposals in DI areas with 50% of the available funds; all remaining qualified DI proposals with all other qualified proposals were then included in the cost effectiveness evaluation and funded accordingly. Table 3 summarizes staff’s recommendation for awards that meet DI criteria totaling $14,179,361. Total NOx reductions from qualified DI projects are approximately 485 tons/year. Table 4 summarizes award recommendations for the remaining funds based on their cost effectiveness ranking totaling $4,748,625, which will result in approximately 179 tons/year of NOx reductions. The proposed awards total $18,927,986 as outlined below:

All of the projects awarded under the above available sources of funding are listed in Table 5. All funds must be expended on a strict timeline. In order to facilitate use of the funds more expeditiously, staff may return to the Board with new funding proposals in the event additional funds become available. Staff will be utilizing the proposals from the RFP 2004-04 solicitation as the basis of these awards.

CARB Interdistrict Program
The AQMD received $201,774 in inter-district funds from CARB on June 16, 2003 for immediate use. The Governing Board approved projects with Ocean Air Environmental for $182,000, and substituted a portion of a previously approved project with Walmart for $19,774. Unfortunately both of these projects have since declined funding due to financial issues with boat owners, and a change in business strategy by Walmart. Staff is recommending approval of another project with Ocean Air Environmental for the tug boat Amy Brusco for $201,774.

Contract Modification
A modification to the contract with California Street Maintenance is requested to correct a miscommunication. At the September 21, 2001 hearing, the Governing Board approved a modification of this contract to LNG street sweepers, the actual request was for LPG street sweepers. All other provisions of the award remain unchanged.

Funding Distribution

As in the past, AQMD exceeds the state requirement of distributing at least 50% of the allocated CMP funds in disproportionately impacted areas. With approval of this board letter, AQMD will have committed $14,179,361 million or 74% of total funding for FY 2002-03 in DI areas qualified under AB 1390, as listed in Table 3.

Disproportionate Impact (DI) Point Ranking

The requirements of AB 1390 are implemented according to the following criteria.
 
1)   All projects must qualify for the Carl Moyer program by meeting the cost effectiveness limits established in the RFP.
 
2)   All projects were evaluated according to the following criteria to qualify for funding under DI requirements:

a)   Poverty Level: All projects in areas where at least 10% of the population falls below the Federal poverty level based on the year 2000 census data, are eligible to be included in this category, and
 
b)   PM Exposure: All projects in areas with the highest 15% of PM concentration will be eligible to be ranked in this category. The highest 15% of PM concentration is 46 micrograms per cubic meter and above, on an annual average, or
 
c)   Air Toxics Exposure: All projects in areas with a cancer risk of 1,000 in a million and above (based on Mates II estimates) will be eligible to be ranked in this category.

Special circumstances existed in some areas, such as the Ports of Long Beach and Los Angeles. Since there are no residents within the ports, poverty ranking could not be established. In this case, the poverty ranking from the adjacent on-shore areas were extended to the port since these populated areas are directly impacted by port activities.

Additionally, potential bidders were notified utilizing the Los Angeles County MTA and Cal Trans Directories of Certified Minority, Women, Disadvantaged and Disabled Veterans Business Enterprises; the Inland Area Opportunity Pages Ethnic/Women Business & Professional Directory; AQMD’s own electronic listing of certified minority vendors; and AQMD Purchasing’s mailing list. Notice of the RFP was mailed to the Black and Latino Legislative Caucuses and various minority chambers of commerce and business associations; and placed on the Internet at AQMD’s Web site [http://www.aqmd.gov, "Business and Job Opportunities" icon] and AQMD’s bidder’s 24-hour telephone message line (909) 396-2724.

Benefits to AQMD

AQMD’s Clean Fuels Program has been active in funding the development and demonstration of low emission, alternative fuel technologies within its Technology Advancement Office. The AQMD has also supported a number of activities directed to commercialization of low-emission alternative fuel technologies. The successful implementation of the Carl Moyer Program is a direct result of these Technology Advancement activities. The proposed projects will have significant emission benefits for many years. Total NOx reductions from the proposed projects are approximately 689 tons per year. The vehicles and equipment proposed will operate many years, providing long-term emissions reductions.

The replacement of diesel-fueled refuse haulers with CNG-fueled refuse haulers, the re-powering of older marine diesel engines with low-emission new diesel engines, and the repowering of older locomotive diesel engines with new low-emission diesel, LNG and diesel/electric hybrids can reduce significant amounts of NOx emissions at an extremely competitive price.

Resource Impacts

Total cost for the proposed projects is $18,927,986 of which funding in the amount of $1,733,115 is from the Clean Fuels Program Fund. The remaining $17,194,871 is from the Carl Moyer Program Fund, established as a special revenue fund resulting from the statewide Carl Moyer Memorial Air Quality Standards Attainment Program administered by ARB. In addition, $201,774 will be used to award a project under the CARB inter-district program. Funds for this project have already been received and have been placed in the Carl Moyer Program Fund. The objective of the Carl Moyer Program is to accelerate the introduction of low-emission heavy-duty engines. Funds are distributed by the ARB through local air districts. Funds from this program are restricted to be used as incentives to private companies or public agencies operating heavy-duty engines in California to cover an incremental portion of the cost of cleaner on-road, off-road, marine engines, and APUs. The AQMD cost share for the FY 2002 - 03 Carl Moyer Program is included in the March 2002 update of the Technology Advancement Plan as 2001CFM-1 "Clean Fuels Program Match for Vehicle and Infrastructure Incentive Programs."

The AQMD is expected to receive $8,148,088 of the available Carl Moyer funds for FY 2003 from CARB. The Carl Moyer Program requires that the local air district provide matching funds for engine, vehicle and equipment incentives on a 1:2 basis. The AQMD local match requirement of $ 4.05 million is met by 1.215 million from program administration support, and other $3.5 million in qualifying infrastructure projects funded from Clean Fuel Funds as listed in Attachment 1.

Monies received from CARB will be placed in the Prop. 40 - Carl Moyer Program Fund. Funds from this program are restricted to be used as incentives to private companies or public agencies operating heavy-duty engines in California to cover an incremental portion of the cost of cleaner on-road, off-road and marine engines.
