This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2004.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month's forecast are summarized.

Rules to be Rescheduled/Removed and Added

Architectural Coatings (CTS-07)

Rule 1113 has been scheduled for July hearing to address U.S.EPA concerns regarding the averaging compliance option.

Control of Nitrogen Oxides from Residential–Type, Natural-Gas-Fired Water Heaters

Rule 1121 is being moved from July to September to provide more time for the technical analysis and to work with stakeholders.

Emission Reductions from Livestock Waste (WST-01 & SB-700)

Rule 1127 is being rescheduled from June to July to allow additional time to address industry comments to the latest rule proposal and to further assess the most current manure composting technology.

Further Control of VOC Emissions from High Emitting Spray Booth Facilities.

Rule 1132 has been scheduled for May hearing to make an administrative change to correct a typographical error in the rule language.

Polyester Resin Operations

Rule 1162 is being rescheduled from June to July to allow adequate time for public input.

Intermodal Equipment

Rule 1198 is being rescheduled from July to September to allow more time to incorporate the latest emission inventory studies and stakeholder input in developing the proposed rule language.

New Source Review of Toxic Air Contaminants for Sources Located Near Sensitive Receptors (EJ)

Rule 1401.1 will be combined with the rule development effort for Rule 1402.1 in September.

Backstop Measures

Rule 2015 has been scheduled for the June hearing to address a U.S. EPA SIP approvability issue regarding breakdown emissions.

3003

Applications

Rule 3003 has been removed from the Rule Forecast Report since District Counsel has determined that a rule amendment is not required to implement SB700.

Below is a list of all rulemaking activity scheduled for the year 2004. The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source-specific toxic-related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located at the end of the report (Attachment D).

Rule Amendments will be required to meet the requirements of SB-700 Air Quality (Florez). Once an analysis has been conducted, specific rules will be identified.

Reg.I, II, IV, IX, X, XI, XIV, XX and XXV Rules

Various rule amendments needed to achieve AQMP emission reduction requirements and other requirements of state and federal law. Also, other administrative changes and various Reg. XIV rules will be evaluated for possible command-and-control rules to reduce toxic emissions as part of the Air Toxics Control Plan.
