This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2004.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month's forecast are summarized.

Facility Permit – Agricultural Facilities

Proposed Rule 223 is being moved from October to the 1st quarter of 2005 to more closely follow the CARB rulemaking effort to define large confined animal feeding operations.

Emissions from Refinery Flares (CMB-07)

Amendments to Rule 1118 are being moved from December to the 1st quarter of 2005. The schedule has been modified to allow completion of the first phase of the control measure, which is collection and evaluation of emission data.

PM10 Emissions Reductions from Cement Manufacturing Operations (BCM-08)

Proposed Rule 1156 is being rescheduled from October 2004 to February of 2005. Additional time is necessary to complete the technical analysis of industry survey data, resolve data discrepancies, and assess the appropriate control technology for the multiple sub-processes.

PM10 Emission Reductions from Aggregate Operations (BCM-08)

Proposed Rule 1157 is being rescheduled from October 2004 to November 2004. Additional time is necessary to discuss and address rule issues raised by the PR1157 Working Group.

Intermodal Equipment

Proposed Rule 1198 is being rescheduled to the 2nd quarter of 2005 because staff is currently working with CARB and other districts in the state to conduct a joint rulemaking for a statewide cargo handling equipment rule for ports and other intermodal facilities. The statewide cargo handling equipment rule is scheduled to be adopted in 2005. Staff may propose local regulation to maximize potential emission reductions in a timely manner.

Below is a list of all rulemaking activity scheduled for the year 2004. The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source-specific toxic-related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other) Upcoming Public Workshops are located at the end of the report (Attachment D).
