This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2005.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD's rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month's forecast are summarized.

Equipment Not Requiring a Written Permit Pursuant to Regulation II

Rule 219 is being moved from July to September to allow additional time for public review and comment.

Regulation III is being moved from May to June to allow additional time for public and Governing Board input.

Facility Permit – Agricultural Facilities (SB 700)

Rule 223 is being removed from the June calendar to the fourth quarter of 2005 to await CARB’s development of a CAF definition and develop appropriate permit structure and emission reduction requirements for the impacted agricultural operations.

Visible Emissions

Rule 401, which was originally scheduled for an amendment in June to comply with SB700, is being moved to TBD. Based on its review of SB700 and other Health & Safety Code requirements, staff has concluded that an amendment to Rule 401 is not required by June 2005. However, staff will continue to evaluate the possibility of applying existing visibility standards to agricultural operations and, if appropriate, develop a proposal for Board’s consideration.

Fugitive Dust

Rule 403 is being moved from May to June 2005 to allow time for additional concepts to be added to the proposal to undergo public review and comment. The new concepts would include control of particulate matter from confined animal facilities pursuant to SB700.

Gasoline Transfer and Dispensing (SB 700)

Rule 461 is being moved from May to June to allow sufficient notice for the Public Workshop.

Control of Emissions from Hog and Poultry Operations

The SB700 requirement to develop Best Management Practices to minimize PM10 emissions from such operations will be covered under Proposed Amended Rule 403, which is scheduled for June. Rule 1127.1 will cover any other needed requirements and is being moved to TBD pending the development of Proposed Amended Rule 403.

New Source Review of Toxic Air Contaminants

Rule 1401 is being added to the schedule for July to add silica to the list of Toxic Air Contaminants listed under Rule 1401.

New Source Review of Toxic Air Contaminants for New and Relocated Facilities Near Schools

Proposed Rule 1401.1 is being moved from May to July in order to receive direction from the Governing Board at the April PR1401.1 Pre-hearing to determine whether to proceed with rulemaking.

2007

Trading Requirements

Rule 2007 has been added to the schedule for May hearing. This proposed amendment will correct the inadvertently omitted power plant authority to transfer credits to facilities under common ownership in the January 7, 2005 amendments to Rule 2007.

The last three columns refer to the type of rule adoption or amendment: AQMP refers to the adoption and implementation of AQMP control measures (Attachment A); Toxics refers to the adoption and implementation of programmatic as well as source-specific toxic-related rules (Attachment B); and Other refers to administrative rules or changes to an existing rule to clarify or improve rule enforceability, SIP corrections, or implementing state or federal regulations (Attachment C). A more detailed description of the proposed rule adoption or amendment is located after this calendar under the type of rule adoption or amendment (i.e. AQMP, Toxics, and Other).
