SYNPOSIS:

The Stationary Source Committee met Friday, November 18, 2005. Following is a summary of that meeting. The next meeting will be December 21, at 10:30 a.m., in Conference Room CC8.

The meeting began at 10:35 a.m. Present were Chairman Ronald Loveridge, Committee Members Jane Carney and Dennis Yates. Absent was Committee Member Gary Ovitt.
 

INFORMATIONAL ITEMS

  1. Proposed Rule 1316 - Requirements for Federal Major Modifications
    Larry Bowen, Planning and Rules Manager, presented this item. PR 1316 is a new rule to meet the New Source Review Reforms mandated by U. S. EPA and meet the stringency requirements required by California Senate Bill 288. Preliminary com-ments by CARB and U.S. EPA Region IX staff are that the proposed rule complies with both federal and state requirements.
     
  2. Proposed Amendments to Reg. IX – New Source Performance Standards and Reg. X – National Emission Standards for Hazardous Pollutants
    Larry Bowen, Planning and Rules Managers, presented this item. The amendments to Regulations IX and X are to update those regulations to comply with recently promulgated amendments to NSPS and NESHAPS by U.S. EPA.

    Committee Member Jane Carney left the meeting for agenda #3 due to a possible con-flict of interest. Ms. Carney announced that Precision Motion Inc. and TMI Products Inc. are sources of income for her.
     
  3. Proposed Amended Rule 1151 – Motor Vehicle and Mobile Equipment Non-Assembly Line Coating Operations
    Larry Bowen, Planning and Rules Manager and Jean Ospital, Health Effects Officer, presented this item. PAR 1151 is to further reduce VOC emissions from automobile refinishing operations and partially implements an AQMP control measure. The rule was developed using a recently adopted CARB Suggested Control Measure as a guideline. The major rule amendments include future effective lower VOC limits, a prohibition of possession of non-compliant coatings, a limited exemption for t-Butyl Acetate (TBAc) and a commitment to evaluate the use of TBAc by July 1, 2007 and make appropriate recommendations to the Board on its further use. Although the compliance dates for some coating categories may be an issue, the major issue is on the proposed limited exemption of TBAc. The proposed rule is expected to achieve a 3.7 tons per day VOC emission reduction with a cost effectiveness of $2,291 per ton of VOCs reduced. The public hearing is scheduled for December 2, 2005.

    Jean Ospital, Health Effects Officer, presented additional information on the regula-tory process of identifying air toxics and carcinogens, and briefly reviewed the regu-latory framework for VOCs and toxics. Additionally, information on the toxicity of TBAc was discussed and staff indicated that there is very limited toxicity data avail-able at this time. The staff recommendation for the proposed rule was consistent with a health protective approach regarding both reducing VOC emissions and the replacement use of potentially toxic substances.

    Following is a summary of public comments:

    Katie Wolf – An exemption, even a limited exemption for TBAc should not be in-cluded until long term toxicity studies can be completed and assessed. Although staff reports the limited exemption will result in a below significant level potential risk, it is still too much. If there is no exemption there will be no risk.

    Dan Pourreau – Developer and manufacturer of TBAc, supports a full exemption for the material. In addition to the technical information described by Dr. Ospital, he will be completing subchronic testing of the material by the middle of next year that should add to the evidence supporting the benefit of TBAc use. He will be sharing the results of that study with the AQMD.

    Rita Loof – The staff report should more clearly acknowledge the emerging availabil-ity of UV/EB technology for automobile refinishing. The rule should also set differ-ent limits for primers and primer surfacers to make it easier for UV coatings to com-ply.

    John Billheimer – The AQMD should use the same evaluation process for existing solvents as it does for new solvents such as TBAc.
